BOARD OF COUNTY COMMISSIONERS
AGENDA REQUEST
DATE: September 15, 2015
TO: Honorable Chairman and Members of the Board
FROM: Jason Autrey
SUBJECT: Acceptance of a stormwater drainage easement for maintenance
DEPARTMENT: Public Works
BCC DISTRICT: 2
STATEMENT OF ISSUE: Staff requests acceptance of an easement and hold harmless
agreement from the Shalimar Point Golf Course for access to, and the maintenance of, an
existing stormwater drainage pond. Included with this easement and agreement is the perpetual
right for County forces to access the drainage pond, to remove accumulated sediment
(demucking) and to modify an existing control structure.
BACKGROUND: Public Works' crews are nearing the completion of Phase I of the Lake
Lorraine Drainage Improvements and the next step of the work requires maintenance to the
existing outfall location. At the discharge point of the improved piping system is an existing
drainage pond that serves as a settling basin prior to overflowing into lakes located on the
Shalimar Point Golf Course. In a study performed of the overall drainage basin this settling area
has been referred to as "Pond 1".
To maximize the effectiveness of the refurbished piping system within the Lake Lorraine
subdivision, it is critical to remove the accumulated sediment, vegetation and debris from Pond
1. Futhermore in an effort to lower the normal water level of Pond 1, the Shalimar Point Golf
Course (through its Board of Directors) has agreed to allow the outfall weir to be lowered by
approximately one foot (1') to elevation 7.50.
In order for the work to be performed by County personnel an easement and hold harmless
agreement has been obtained from the Shalimar Point Golf Course that will allow access to the
pond, work to be performed within the pond and the authority to modify the existing outfall weir.
The easement has been approved by the Shalimar Point Golf Course Board of Directors and is
ready for acceptance by the Board of County Commissioners.
If accepted crews will schedule the work within Pond 1 as part of the ongoing Lake Lorraine
Drainage Improvement Project. There are no fees associated with the easement/agreement nor
any charges applied to the Shalimar Point Golf Course.
OPTIONS: Approve/Deny acceptance of the drainage easement and hold harmless agreement
from the Shalimar Point Golf Course for permanent access and maintenance of Pond 1 adjacent
to the Lake Lorraine Subdivision.
RECOMMENDATIONS: Staff recommends acceptance of the drainage easement and hold
harmless agreement from the Shalimar Point Golf Course for permanent access and maintenance
of Pond 1 adjacent to the Lake Lorraine Subdivision.
