Message Page 1 of 1 EXHIBIT 11 Peggy Fowler From: Michael Bryant Sent: Tuesday, November 07, 2006 11 : 56 AM To: Peggy Fowler Cc: Thomas Murray; Jeff Glassburn Subject: Downtown Parking Lot (AKA Tringas Parking Lot) Peggy, In regards to the Tringas Parking Lot, all available data indicates that there is a gap between the City owned parcel and the Tringas owned parcel. Some of our old maps refer to this gap as Point Place. Unfortunately there has never been a survey done showing both the City and the Tringas property on one survey. That type of survey would clearly indicate a hiatus if indeed one exists. Regarding ownership of the hiatus, since there is no subdivision plat covering that property, there is no way a right~of-way was dedicated to the City on a plat. Also, to the best of my knowledge there is no deed conveying that property to the City. The bottom line is that we believe there is a gap between the City property and the Tringas property. Establishing ownership of that property would be a matter for the City attorney in my opinion.
