BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: August 16, 2016 TO: Honorable Chairman and Members of the Board FROM: Jason Autrey SUBJECT: Acceptance of a stormwater drainage easement near Sunset Boulevard West DEPARTMENT: Public Works BCC DISTRICT: 4 STATEMENT OF ISSUE: Staff requests acceptance of a 15’ wide drainage easement for an existing drainage system serving Sunset Boulevard West. BACKGROUND: An existing drainage system located within private properties is conveying stormwater runoff from Sunset Boulevard West, a County maintained road, into the adjacent Cinco Bayou. The drainage system is being maintained by the County; however, there is currently no adequate easement to cover the drainage system within the said properties. Ms. Mitzi Prince Henley, the owner of the existing residential lot (with the southwestern portion of the pipe) has offered to dedicate a 15’ wide drainage easement. A 20’ drainage easement (not included in this request) to cover the northeastern portion of the pipe will be dedicated to the County in the final plat of Sunset Pointe subdivision which is also owned by Ms. Henley. The drainage easement will grant the County legal access to the existing drainage system for construction, maintenance, and servicing as needed in the future. OPTIONS: Approve/Deny acceptance and recording of the drainage easement from Ms. Mitzi Prince Henley. RECOMMENDATIONS: Staff recommends acceptance and recording of the 15’ drainage easement, provided by Ms. Mitzi Prince Henley, for the southwestern portion of the existing drainage system located in her property.
