STATEMENT OF ISSUE: On June 10, 1980, the Board of County Commissioners adopted
Ordinance 80-18 creating the Kell-Aire Gardens Subdivision Municipal Service Taxing Unit.
The purpose of the Municipal Services Taxing Unit was to provide essential infrastructure within
the subdivision. The Municipal Service Taxing Unit was able to attain its goals and the
necessary infrastructure has been provided. Subsequently, the subdivision has been annexed into
the municipal boundaries of the City of Destin. As its purposes have been achieved, the Board
needs to consider the repeal of the Unit.
BACKGROUND AND ANALYSIS: On June 10, 1980, the Board of County Commissioners
adopted Ordinance 80-18 creating the Kell-Aire Gardens Subdivision Municipal Service Taxing
Unit. The purpose of the Municipal Services Taxing Unit was to provide essential infrastructure
within the subdivision. The Municipal Service Taxing Unit was able to attain its goals and the
necessary infrastructure has been provided. Subsequently, the subdivision has been annexed into
the municipal boundaries of the City of Destin. On October 4, 1983, the Board of County
Commissioner, following completion of the improvements, approved the disbursement of
remaining funds in the Special Assessment Fund to the properties in the Kell-Aire Gardens
Subdivision Municipal Services Taxing Unit representing their shares of the balance in the
Special Assessment Fund. As the purpose of the Municipal Services Taxing Unit has been
achieved and the surplus funds returned to the property owners, the only action remaining is the
formal repeal of the Unit.
OPTIONS: Approve/Disapprove the scheduling of a public hearing for the adoption of an
Ordinance for the repeal of the Kell-Aire Gardens Subdivision Municipal Service Taxing Unit.
RECOMMENDATION: Approve the scheduling of a public hearing for the adoption of an
Ordinance for the repeal of the Kell-Aire Gardens Subdivision Municipal Service Taxing Unit, to
be heard at the Board’s July 21th, 2016 meeting and direct staff to advertise the Ordinance as
required by law.
