Approval of a Site Development Plan for Old Fort Walton Subdivision The City Attorney advised the following three agenda items fall under a quasi -judicial proceeding and gave the oath to those who planned to testify on these items. He asked for any ex -parte communication from Council on these items. Council advised they spoke with Mrs. Bowen on the matter. Ms. gossom stated she had a conversation with two of her neighbors regarding the issue, but u spoke to one else. f Ms. Jones advised the request is for approval of a site development for Old Fort Walton 5 Subdivision, a six -lot single family residential subdivision at the intersection of Pryor Road SE and Brooks Street SE. The Development Order was entered into the record. Pnn G Ms. Jones continued the proposed development is consistent with the City' s Comprehensive Plan and meets the minimum requirements of the City' s Land Development Code, and that the MPH recommended approval at their December I, 2011 meeting, and that Staff recommends approval as well. M Benny Bowen, 361 Brooks Street, expressed concern that the home proposed for Lot 1 does not face Brooks Street and that his family will be forced to look at the neighboring backyard from the inside of their home, thus downgrading the value of his home. E su Dorothy Bowen, 361 Brooks Street, objected to the homes backing up to her property and p a requested that the developer meet with the Board of Adjustment to obtain a variance so the home could face Brooks Street. Council discussed the issue at length including the rights of property owners vs. homeowners; historical nature of the property and the neighborhood; and the aesthetics of the neighborhood. The City Attorney advised that since the project meets the requirements of the City, Council should vote for it, although they can vote against it if they feel inclined to. He cautioned, however, that if denied the developer does have the right to repeal the action and seek recourse. The vote on the motion to approve the Site Development Plan and Development Order for Old Fort Walton Subdivision at the intersection of Pryor Road SE and Brooks Street SE carried by a vote of 5 to 2.
