Designation of a Historic Site or Structure, Demolition ofa Structure Over 50 Years Old, or Request for Waiver from Archaeological and Historic Preservation Act. $ 200 filing ,fee. This process no longer exists and the application is no longer applicable. Historic preservation review has been incorporated into the regular development review process. 2. 3. Addition of Fees: 2.3. 1. Notice of Intent to File an Appeal of Administrative Decision. $ 75. 00. The ability to file a notice of intent prior to an application was added to the new Land Development Code in order to allow applicants to initiate the process within the required time frame without incurring major costs. The fee covers staff time to process and document the request. 2.3. 2. Request for Administrative Waiver. $ 125. 00. This application and process replaces the variance process for minor requests. The fee covers staff time to review, provide determination, and document the request. 2. 3. 3. Minor Plat. $ 270. 00. The Minor Plat application replaces the subdivision plat application for minor requests approved at a staff level. The process time for review and approval is equivalent to that of a preliminary plat, thus, the fee is equivalent to the preliminary plat fee. 2.3. 4. Planed Unit Development Application. $ 1, 650. 00. The revised Land Development Code includes clear, streamlined procedures for review of a Planned Unit Development ( PUD). The previous LDC referred to several different applications in order to process and review a PUD, and therefore staff had to charge several different fees in order to process a PUD application using the current fee schedule. The proposed fee combines the rezoning fee and the major development order fee for a total flat fee of $1, 650. 00. 2. 3. 5. Pre -Application Conference. $ 75. 00. The revised Land Development Code includes the provision of a pro -application conference prior to the submittal of a development order, which allows the application to " round- table" their project with City staff from every applicable Department during one sitting. The fee covers the staff time to prepare for and conduct the meeting. 2. 3. 6. Posted Property Notice, per sign. $ 45. 00. The revised Land Development Code requires properties with a site -specific planning application to place a sign at their property notifying the public of the proposed development This notice replaces part of the previous process of holding several public hearings. The revised LDC allows the applicant to pay a flat fee to the City to post the property in lieu of it being the applicant' s responsibility in order to provide more flexibility. The fee covers the City' s cost to produce and install the sign. 237. Mailed Notices. $ 21. 50. The revised Land Development Code requires that letters be mailed to surrounding property owners for certain planning and development applications. The revised LDC allows the applicant to pay a flat fee to the City in lieu of it being the applicant' s responsibility in order to PackM Pg. 106 0. 4 RESOLUTION ( ID # 1864) provide more flexibility. The fee includes postage and printing costs for the average number of properties that surround a typical site. The fee also covers staff time to produce and mail the letters. 23. 8. Application for Expedited Development Order. $ 39.00. The new Land Development Code was streamlined to provide a clear process for two types of development applications. The Expedited Development Order Application fee proposed is $ 39. 00 because it is the planning application equivalent of a building permit base application fec. The fee only covers the staff time involved in receiving application, reviewing the application for sufficiency, and preparing the final memorandum and development order for the application. The fee does not cover the technical review of the application. 23. 9. Application for a Major Development Order. $ 725.00. The new Land Development Code includes a clear process for two types of development applications. The Major Development Order review includes those applications that take much more processing time and must be forwarded to City Council for final review and approval. The fee includes the cost of a legal advertisement plus the staff processing time. 2. 3. 10. Minor Amendment to Development Order. $75. 00. The new Land Development Code includes a clear process for revising already submitted development order applications. The fee covers staff time to determine whether the request is consistent with the City' s Land Development Code as well as review the original development order against the requested amendment. 2. 3. 11. Major Amendment to Development Order. $ 450. 00. The fee covers the legal advertisement cost of the application as well as the processing time to review the request and place on the City Council agenda for final approval. 2.4. Revisions to Existing Fees: 2. 4. 1. Appeals of Administrative Decisions. Revised from $415. 00 to $ 1, 500. 00. This process now includes appeals of or " contesting" development applications approved at a staff level. The application would be reviewed and prepared by staff and include a " de nova" hearing by the Board of Adjustment, which means the review and process time would start from the beginning as if it were a new application. It would then be forwarded to the Board of Adjustment and possibly City Council for final approval. The fee covers the costs of legal advertisements and staff review and processing time. The fee is also meant to discourage frivolous appeal applications. 2. 4. 2. Variance Request. Revised from $ 415. 00 to $ 925. 00. The proper variance Process is equivalent to the processing and review time of a rezoning request; therefore, the fee is equivalent to the rezoning fee. 2. 4. 3. Site Plan Review. Revised to clarify language and streamline the fee structure. The current fee schedule for Site Plan Review has a category for residential and a category for commercial. The proposed fee uses the lower fee of the two, and Packet Pg. 109 10. 4 RESOLUTION ( ID # 1864) combines the fee structure into only one category. The fee continues to be applied " per 100 square feet ", however, the language has been revised to include a review fee for improved site area or gross floor area, whichever is greater. This captures many projects that do not necessarily include a building. The language was also revised to clarify that the Site Plan Review fee includes all multi- family residential and commercial projects. 2. 5. The fee schedule is also being revised to remove an obsolete fee for " Special event boxes w/ two 60 gal plastic liners ". This type of sanitation collection is no longer offered. 2. 6. The fee schedule is also being revised to remove the 20% cap for adjustments to golf club green, cart, and tournament fees. The purpose of eliminating the cap is to enable the Golf Club Manager, with concurrence of the Recreation Director and City Manager, to reduce rates to promote play during slow periods. Recent promotions include kids play free with a parent and complimentary green fees for city employees ( must pay cart fee). 3. FINANCIAL INFORMATION: 3. 1. Resolution 2012 -15 amends the City' s Comprehensive Fee Schedule, which authorizes the City to collect fees for certain services. 3. 2. The amended fee schedule will likely affect the amount of annual revenue collected for the specified services. The amount of revenue collected, however, is based on the number of LDC applications received or off p - eak city employee golf rounds played. 4. RECOMMENDATION: 4. 1. Staff respectfully recommends City Council approval of
