To: Robert T. Mearns, City Manager
From: Michael Beedie, Engineering & Utility Services Director
Date: April 26, 2011
Subject: Ordinance 1850 - Amend the LDC
1. REQUEST:
1. 1. The City received an application from Kendrick David Dowling Architects, Inc.,
authorized agent on behalf of Harbour Place LLC, requesting to amend the Land
Development Code ( LDC) to increase the maximum allowable density in the R -2
Multiple Family) zoning district from 15 dwelling units /acre to 20 dwelling units /acre
du/ ac).
1. 2. The applicant paid the required $925. 00 application fee and deposit on March 23, 2011.
1. 3. The applicant desires to " increase the density of the allowable units per acre allowing
more efficient use of medium density zoned properties."
2. BACKGROUND:
2. 1. Land Use Designation - The R -2 zoning district permits single and multiple family
dwellings including apartments, townhomes, and condominiums. The R -2 zoning
district is generally applied to interior areas of the City, primarily in the Community
Redevelopment Area along Third Street, Park Circle, Carson Drive, and Alder Avenue
to implement the MDR category of the Comprehensive Plan.
2. 2. City Council approved the Site Plan for the Harbour Place /Marty Lackey FRESH Start
center on September 23, 2008. The development has two phases - Phase I has been
constructed and Phase II is yet to be constructed. Phase I was approved for 10 units and
Phase II was approved for 8 units. If the LDC text amendment request is approved,
Harbour Place will apply for a Site Plan amendment to request 2 additional units for
each phase of development, for a total of 12 units at Phase I and 10 units at Phase II.
3. DISCUSSION:
3. 1. Consistency with the Comprehensive Plan
3. 1. 1. The recently adopted Comprehensive Plan ( 2011 -2021) allows a maximum
standard density of 20 du/ ac for the MDR (medium density residential) land use
district. The Land Development Code allows a maximum density of 15 du/ ac in
the R -2 district. The City is currently in the process of updating the Land
Development Code to be consistent with the Comprehensive Plan 2011 -2021,
but because of the amount of changes needed for the LDC, the revisions are not
expected to be adopted until early 2012. The applicant wishes to move forward
with a site plan based on the updated Comprehensive Plan before 2012 and is
therefore making a request that the LDC be amended.
3. 2. Density Analysis
3. 2. 1. Staff has analyzed the site specific parameters /design of the proposed
development as well as the population implications of changing the maximum
density from 15 du/ac to 20 du /ac district wide in the R -2 zoning district ( See
Table 3. 1 below). Staff has also analyzed the adopted Level of Service ( LOS)
standards against the density increase based on a " worst case / maximum
buildout scenario" whereby every property in R
