STATEMENT OF ISSUE: As part of a longstanding development issue, Northgate
Development Company (along with various landowning partners) has been attempting to modify
an existing variance for five parcels they have an interest in along Martin Luther King Jr. Blvd.
The Board of Adjustments granted the variance requests made by Northgate where one of the
conditions included the acceptance of payment from the applicant for roadway improvements.
As the Board of Adjustments is not authorized to accept payment on behalf of the County, this is
a request to authorize the acceptance of the funds in order to complete the variance that was
granted.
BACKGROUND: Northgate Development Co., along with other interested parties, has been
seeking relief to the Land Development Code regulations regarding limited access to parcels
along Martin Luther King Jr. Blvd. An original variance granted in 2005 included a stipulation
that a roadway be realigned; however because of extenuating circumstances related to a wetland
and existing utilities it was determined that specific condition of the variance could not be met.
In an effort to offset that complication, Northgate Development requested the variance be
modified into three individual variances and to allow for the applicant to make a payment to the
County for the installation of a turn lane at the intersection of Martin Luther King Jr. Blvd and
Florence Ave in lieu of the roadway realignment. The request for the variance modification(s)
was granted on March 13, 2013 by the Board of Adjustments. A copy of each of the three revised
variances is attached hereto.
As part of the modified variance approval it was required that the acceptance of the funds be
authorized by the Board of County Commissioners as the Board of Adjustments cannot accept or
expend funds on behalf of the County. The lump sum payment by Northgate Development, for a
value of $30,000.00, will be utilized toward the existing Martin Luther King Jr. Blvd
improvement project to install a left turn lane for southbound traffic to turn onto Florence Ave.
No improvements are allowed on any of the related parcels until the payment has been made.
OPTIONS: Approve/Disapprove acceptance of a lump sum payment in the amount of
$30,000.00 from Northgate Development Co. as a condition of the variances approved by the
Board of Adjustments.
RECOMMENDATIONS: Approve acceptance of a lump sum payment in the amount of
$30,000.00 from Northgate Development Co. as a condition of the variances approved by the
Board of Adjustments.
