BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: April 2, 2013 TO: Honorable Chairman and Members of the Board FROM: Jeff Littrell SUBJECT: Eglin Wastewater Treatment Contract Modification for Flow Charges DEPARTMENT: Water and Sewer BCC DISTRICT: 1, 2 & 3 STATEMENT OF ISSUE: OCWS staff is requesting approval from the BCC for the execution of a third contract modification with Eglin Air Force Base for the flow charges (AKA monthly billing rates) related to transmitting, treating, and disposing of Eglin AFB's wastewater at Duke Field, Main Base, and Camp Rudder. BACKGROUND: In September 2011, Okaloosa County went under contract (FA2823-11-C- 0030; County Contract No. C11-1906-WS) with the U.S. Air Force for the construction of the Duke Field wastewater infrastructure. The contract was modified in August 2012 to add the following: Capacity Expansion Charges (CECs) for Duke Field, construction costs for Main Base wastewater infrastructure, CECs for Main Base, construction costs for Camp Rudder wastewater infrastructure, and CECs for Camp Rudder. The total contract is now $16,699,568; of that, $8,026,192 is reimbursement of design and construction costs, and $8,673,376 is for CECs. Eglin AFB would now like to execute a third contract modification to include the flow charges. As stated in the contract modification itself, "The purpose of this modification is to add the flow charges that Okaloosa County will charge Eglin AFB for Wastewater Treatment". The modification will incorporate no funds and is just an agreement of the allowable charges for services. There will be no money assigned to this modification. The attached modification states what our monthly usage charges are per 1,000 gallons and what our readiness-to-serve charges are per line size. The BCC-approved 5-year rate plan is reflected on the attached document. With regards to annual revenue generated from this contract, a conservative estimate is $850,000/year (550,000 gallons per day total of average daily flow). Also attached is the completed County Contract Review Coordination Sheet. OCWS staff anticipates further contract modifications to extend the period of performance. This is due to delays caused by circumstances beyond our control - either varying site conditions or government delays (waiting for approvals during the step-by-step process). We are coordinating and communicating with Eglin weekly on these issues so there will be no surprises. At this time, we are also requesting the Chairman be given authority to execute future contract modifications which only involve time extensions. OPTIONS: Approve or Deny. RECOMMENDATIONS: OCWS staff recommends approval by the BCC to authorize the Chairman to execute the third contract modification to the Eglin Wastewater Treatment Re- configuration contract (FA2823-11-C-0030) for the flow charges associated with wastewater from Duke Field, Main Base, and Camp Rudder. OCWS staff also recommends approval by the BCC to authorize the Chairman to execute any future contract modifications and related paperwork which only involve time extensions. RECOMMENDED BY: APPROVED BY: James D. Curry, County Administrator
