From: Parsons, Kerry To: Zan Fedorak Cc: Roland Sims; Brenda Bailey; Hoshihara, Lynn Subject: RE: Okaloosa Board of County Commissioners meeting agenda request Date: Tuesday, June 14, 2016 8:40:14 AM Attachments: image001.png Zan: This Interlocal agreement is approved for legal sufficiency. It should be noted that some of the citations in this documents could have been more clearly worded and that there are some grammatical errors, such as “county” vs. “counties”. However, we are not going to hold this up from proceeding forward we just wanted to point that out. Zan to address your concern with some of the language regarding the liability… That language comes directly from the United States Code. Much of the language in the Interlocal comes from the USC, and as much as we would love to change it, because it is statutory, we cannot. I hope this addresses your concerns. Please let me know if you have additional questions. Kerry From: Zan Fedorak [mailto:zfedorak@co.okaloosa.fl.us] Sent: Monday, June 06, 2016 5:04 PM To: Parsons, Kerry; Hoshihara, Lynn Cc: Roland Sims; Brenda Bailey Subject: FW: Okaloosa Board of County Commissioners meeting agenda request Good Afternoon Lynn & Kerry, Sue Berntsen with Career Source Okaloosa Walton provided the attached documents to Roland for the June 21st agenda. I have reviewed the document and I have concerns with the language. In paragraph 1. It states that the “Chief Elected Official shall serve as the local grant recipient and the Chief Elected Official hereby designates CAREERSOURCE OKALOOSA WALTON (CSOW) to serve as the Fiscal Agent.” It also states in the same paragraph “However, the Chief Elected Official is not relieved of the liability for any misuse of grant funds.” I do not have the grant document to review but I am assuming that this is the new requirement with Federal funds that the grant recipient is fully responsible for all activities and expenditures by the sub-recipient. I did not see anything within the remainder of the document that required CSOW to provide any type of grant assurances to the County to ensure that the grant requirements were being met. I have also included the previous interlocal agreement. (08.14 -06.16) for reference. The language has obviously changed a good deal since the previous interlocal was established. Please let me know if I’m way off so I can learn from this situation.
