TOURIST DEVELOPMENT - REQUEST WAIVER OF TERM LIMIT FOR TDC
CHAIRMAN
Mr. Daniel O'Byrne, Tourist Development Director, asked
consideration of a request from the Tourist Development Council
(TDC) to waive the two one-year term limit provision of the TDC
Operations & Procedures Manual regarding the election of TDC
Chairman and Vice Chairman. He reported that at its meeting on
August 22, the TDC unanimously approved a recommendation to the
Board to waive this provision and unanimously nominated Kathy
Houchins to continue in a third term as TDC Chairman and to
forward that recommendation to the Board of County
Commissioners. (This item was previously before the Board on
October 16 but was tabled.)
Upon inguiry by Mr. Amunds, Mr. O’Bryne stated he is unaware of
the Board waiving any TDC policies over the last eight years.
Mr. Parisot said he does not believe it is necessary to do this,
adding that Ms. Houchins is doing a great job. He noted he
requested this item be returned to the TDC for discussion but
was unable to be present at that meeting. It was his belief
there should be a turnover of TDC members in order to get fresh
ideas. Mr. Parisot stated the TDC is an advisory committee and
he does not believe retaining long-term membership 1s necessary.
He said these policy and procedures were just approved
(September 18) and questioned the request to waive the policy.
Mr. Harris did not support waiving the policy and believed doing
so would send the wrong message. He stated he has personally
spoken with Ms. Houchins on this issue.
Mr. Windes agreed that Ms. Houchins has done a good job. He
said there are times when you need to waive policy but he does
not think this is one of those times.
Mr. Windes made motion, seconded by Mr. Parisot, to deny the
request to waive the term limit provision in the TDC Operations
& Procedures Manual. 5 yeas.

FACILITIES MAINTENANCE - FUNDING REQUEST TO COMPLETE ELDER
SERVICES LEASED SPACE
Mr. John Hofstad, Public Works Director, requested $13,800 from
the General Fund Capital Outlay Judicial Reserves be approved to
complete the remodeling of the space in the old Fort Walton
Beach Hospital leased to Elder Services. The asbestos survey
and abatement phase of the project took longer than expected,
pushing the actual remodeling work close to the end of the
fiscal year. Once it was realized the work would not be
completed in Fiscal Year 2012, the opportunity to request
funding for the Fiscal Year 2013 Budget had passed. Mr. Parisot
made motion, seconded by Mr. Harris, to approve the funding
request. 5 yeas.
FACILITIES MAINTENANCE ~ CRESTVIEW HISTORICAL PRESERVATION GROUP
REQUEST TO PLACE ITEMS IN CRESTVIEW COURTHOUSE
Mr. Hofstad stated at the last meeting the Crestview Historical
Preservation Group approached the Board regarding placement of
historical pictures, maps, documents, and other artifacts in the
Crestview Courthouse. The displays will be digitally reproduced
and the Facilities Maintenance Department has been asked to be
responsible for mounting the items to the walls. The Historical
Preservation Group will determine which artifacts to display.
Mr. Harris made motion, seconded by Mr. Boyles, to approve the
request for display in designated areas of the Crestview
Courthouse. Mr. Amunds stated there should be a joint decision
between the Group and the Board. Mr. Harris said the Board will
have oversight. 5 yeas.
COUNTY ADMINISTRATOR - UPDATE ON VETERANS PARK
Mr. Curry stated the Master Plan for the county’s Island Golf
Property included an area to be set aside for commercial
purposes as a revenue source to maintain the facilities.
Contracts/leases were executed with Wild Willy’s and AquaGreen.
A separate fund is to be set up for maintenance of the park
facility, advising an overview will be brought to the Board at
the next meeting. Upon inquiry by Mr. Amunds, Mr. Curry stated
the Clerk’s Office can set up the account.

WATER & SEWER - INTERLOCAL AGREEMENT WITH TOWN OF SHALIMAR FOR
FRANCHISE RIGHTS AND COLLECTION/PAYMENT OF FEES
Mr. Jeff Littrell, Water & Sewer System Director, requested
approval of an interlocal agreement with the Town of Shalimar to
continue Okaloosa County Water & Sewer System’s franchise rights
and the collection of taxes.
Mr. Parisot stated there were some misplaced modifiers in the
document and posed a concern about language which allows the
Town to adjust the 5% collection fee by way of a town ordinance.
Mr. Parisot said he sent emails to both Mr. Dowd and Town
officials regarding this issue. He recommended Section XII be
amended to read:
Town of Shalimar utility taxes on water and sewer
services according to governing Town of Shalimar
ordinances will be collected and disbursed to the
Town by the County after a reasonable collection
fee not to exceed 5% of collected taxes.
Mr. Dowd agreed with Mr. Parisot and noted this is a minor
modification. Mr. Littrell stated the modified agreement will
be returned to the Town Council for approval. Mr. Parisot made
motion, seconded by Mr. Boyles, to approve the interlocal
agreement with the Town of Shalimar with the modifications
proposed by Mr. Parisot. 5 yeas.
PUBLIC HEARING - REQUEST OF PHILLIP AND DEBORAH JENNINGS TO
VACATE PORTION OF 157" STREET IN PINE CREST S/D, NICEVILLE (9:00
A.M.
Mr. Stanford read the advertised legal notice for public hearing
to consider the request of Mr. and Mrs. Phillip Jennings to
vacate the northern one-half of unimproved 15°" Street, measuring
25 feet by 150 feet and lying west of Pine Avenue and south of
and adjacent to Lots 10, 11, and 12 of Block 66, Valparaiso
Realty Company’s Pine Crest Addition to Valparaiso. (This
hearing was originally before the Board on October 16 but tabled
until today.)
Mr. Hofstad stated this item was before the commissioners last
month but additional details were requested. He said a number
of photographs have been taken to provide greater details of the
area.
November 20, 2012 -6- Minute Book 68, Page 51
Okaloosa County Board of County Commissioners
Mr. Hofstad stated the Jennings are requesting vacation of an
unimproved portion of 15‘" Street measuring 25’x150’. He advised
the adjoining portion was previously vacated in the 1990s. Mr.
Hofstad stated if approved, the resolution vacating the right-
of-way will reserve county access and use for drainage. If Mr.
Jennings installs a fence on the vacated portion and the county
needs it for drainage, Mr. Jennings will be required to remove
the fence. He advised that an alternate resolution has been
prepared, vacating a strip 20 feet in width rather than 25 feet.
This would provide an additional five feet for public use. Mr.
Hofstad added the only opposition to the vacation has been from
the Watts family.
Mr. Amunds opened the floor for public comment but no one came
forward to. speak. Mr. Harris made motion to approve the
vacation as requested by the Jennings.
Mr. Windes stated that he went on site Saturday and spoke with
both Mr. Jennings and Mr. Watts. He said there are no sidewalks
in this area and Mr. Watts wants to protect the children by
having ample space for them to walk in the neighborhood. Mr.
Windes stated Mr. Jennings said it would be acceptable to
decrease the width of the vacated right-of-way to 20 feet and
Mr. Watts, the neighbor, agreed to that as well.
Mr. Harris withdrew his motion. Mr. Windes made motion, to
adopt the alternate resolution, vacating a strip 20’x150’.
Mr. Parisot stated he went to the location on Sunday and it
appears to him there is already enough space for foot traffic
between where a fence would go and the shrubs. He stated the
property owner who received vacated right-of-way in the 1990s
did not give anything up. Mr. Windes noted that would be a
narrow and confined alleyway. Mr. Harris stated there appears
to be agreement between both parties and seconded Mr. Windes’
motion. Mr. Boyles felt Mr. Parisot’s comments were misplaced
regarding the portion which was previously vacated. He said it
is regrettable the previous right-of-way vacation in the 1990s
had no provision for public use but there is nothing which can
be done about that now. Mr. Boyles stated he is sympathetic to
the Jennings’ request but he is looking how that right-of-way
may have future use.
Mr. Amunds reopened the floor for public comments. Mr. Jennings
stated he is basically in a position of “winning 20 feet.” He
said Mr. Parisot and Mr. Windes were able to see the area first

hand. Mr. Jennings said from where the flags were set to the
south there is sufficient distance for foot traffic and a
bicycle path. He stated his primary concern was the motorized
vehicles coming through.
The vote was taken on the motion---5 yeas.
RESOLUTION NO. 12-168
PUBLIC HEARING - AMENDING CHAPTERS 1A AND 2, LAND DEVELOPMENT
CODE (9:00 A.M.)
Mr. Stanford read the advertised legal notice for a public
hearing to consider changes to the Land Development Code (LDC)
Submitted by the Growth Management Department, amending Chapter
1A Code Administration and Chapter 2 Zoning Regulations. This
is the second hearing. The first hearing was held on
November 6, 2012 in Crestview.
Mr. Elliot Kampert, Growth Management Director, provided the
following staff findings:
e Section 1A.02.11 “Permits from Other Agencies.” A change
to this section is necessary in order to make the LDC
consistent with current state law. _ During the 2012
session, the Legislature enacted House Bill 503 which
amended Section 125.022, Florida Statutes. This provision
prohibits counties from requiring permit approvals from
other agencies as a prerequisite to issuing development
orders or permits. Currently, the LDC requires permit
approvals from other agencies before a development order
can be approved.
e The County substantially revised Chapter 2 “Zoning
Regulations” in May 2010. These revisions identified
permitted uses in commercial and industrial zoning
districts according to the North American = Industry
Classification Systems (NAICS) codes. This was done to
provide a more descriptive and inclusive list of permitted
uses based on the types of businesses identified in the
NAICS by the U.S. Census Bureau. The NAICS is the more
comprehensive and authoritative list of officially
recognized businesses in the county and it is updated every
five years as part of the Economic Census. The most recent
update is for 2012. As a result, staff took this
opportunity to re-evaluate NAICS codes in relation to those
currently listed in Chapter 2. The proposed changes are:

gliders, helicopter rides and hot air balloon rides.
Ms. Virginia Hickman stated she lives in East Pass Towers and
represents a number of residents. She complained about the use
of a barge near the front of this property being used for
helicopters landings. Ms. Hickman was concerned about the small
boat traffic in the area. She also said she is unable to sit on
the balcony because of the noise from the helicopters.
Ms. Hickman said it was her understanding there was a moratorium
on these type operations and asked how the helicopter company
can do this. Mr. Amunds replied the county does not regulate
the waterways. He explained the provisions of the Land
Development Code do not cover the water. Mr. Dowd added that he
is currently researching the issue to see what can be done.
Mr. David Powell, attorney with the Ward & Ketchersid Law Firm
and representing Timberview Helicopter and Destin Helicopter,
stated his clients don’t want to land on barges. He said they
want a place to do business and the airport is not feasible.
Mr. Powell stated the site previously used by his clients did
not require a development order because they were not developing
anything and under the C-3 Zoning their helicopter operation was
an accepted use. Subsequently, Mr. Powell said they found
themselves going to the county when FDOT required approval from
the county. He pointed out they were using a temporary permit
at that time. Mr. Powell said Timberview was making application
when the moratorium was adopted by the Board. He stated his
clients had no prior notice the moratorium ordinance would be
adopted on an emergency basis on June 19. Mr. Powell commented
“They were told not to apply.” Mr. Amunds asked for
Clarification on who told Timberview not to apply. Mr. Powell
replied, “Let me think how they phrased it.”
Mr. Harris asked Mr. Powell if he is saying when his clients
went to FDOT they were told to go the county for a permit. Mr.
Powell answered that he has not spoken with FDOT directly but
did see a letter from FDOT requiring local zoning approval. Mr.
Kampert noted that is no longer a requirement in Section lA.
The new requirement is to comply with other agencies for permits
and the county cannot predicate a permit on other agencies.
Mr. Parisot referred to Judge Remington’s order of July 30 which
stated that neither of the plaintiffs submitted an application.
November 20, 2012 -10- Minute Book 68, Page 55
Okaloosa County Board of County Commissioners
The application was made by the owner of Destin Commons. Mr.
Powell confirmed that the landowner did file. He also advised
the court case referenced by Mr. Parisot is not his lawsuit.
Continuing, Mr. Powell stated his clients were caught in “no
man’s land” with FDOT and then could not file when the
moratorium was adopted. He advised that FDOT read this
conservatively and told his clients FDOT could not approve the
permit request. Mr. Powell asked why there are no moratoriums
on any other proposed changes. He said the only opportunity his
clients may have to file is in the “gap” between the effective
date of the moratorium and the effective date of the proposed
ordinance.
Upon inquiry by Mr. Harris, Mr. Powell said his clients were
flying from a C-3 parcel at the time of the moratorium. Mr.
Parisot noted they were flying out of the Destin Commons parking
lot. Mr. Powell stated the other company (competitor) was
developing raw land and received approval during a public
hearing. He said they will have protection under the current
code.
Mr. Dowd stated Mr. Powell’s clients were parties in the lawsuit
referenced by Mr. Parisot earlier and in that lawsuit’ the
grandfathering-in issue was addressed. Mr. Parisot said the
judge’s order clarified the issue and there was no application
for permanent relief.
Mr. Windes stated he spoke with FDOT’s Airport Regional Manager
on public and private airports. He detailed the information
provided to him about the 14 facilities in the region. Mr.
Windes said between the court case and the information he
obtained, it appears there has been a lack of effort on the part
of these businesses to qualify and follow the proper procedures.
Mr. Dowd noted the issue before the Board is not about
helicopter operations but about amending the Land Development
Code. He said there could be a “window” for application if the
board agrees to that provision. Mr. Windes replied that he has
concerns about that provision which would allow anyone in after
all that has taken place. He pointed out this has already been
to court and been denied.
Mr. Windes stated this iS an important issue for the Destin
area. He said it affects the people who live here and
diminishes “our product.” Mr. Windes asked who will protect our

Okaloosa County Board of County Commissioners
people if the Board does not. Mr. Windes made motion to approve
the proposed amendments to the LDC.
Mr. Harris said he will play the devil’s advocate for a moment.
He said previously helicopter sightseeing operations were
allowed in a C-3 zone but the proposed changes will not allow
them. Mr. Kampert confirmed that C-3 did allow helicopter
Sightseeing businesses. Mr. Harris said both Timberview and
Destin Helicopter did what was allowed at the time. He also
asked the question how one company had sufficient time to make
application but the others did not. Mr. Harris then asked if
this action is interfering with commerce. Mr. Amunds responded
that if Timberview would have made application instead of the
owner of Destin Commons, then Timberview would have a site. Mr.
Harris said he does not want to pick winners and losers and
asked if the Board is changing the law in the middle of the
stream.
Mr. Boyles stated he was in the audience when the previous
public hearing took place and pointed out that Timberview was
also in the audience. He said he came away from that meeting
with the understanding things were about to change. Mr. Boyles
stated he cannot take the position that Timberview did not know
change was coming and coming quickly. He added that the county
is not running them out of Destin or the county because they can
move their operations to the airport. They also have the option
of finding another site and having it rezoned.
Mr. Parisot said he will support the amendment with an effective
date as soon as possible. He added that he believes the Board
is responsible for ground safety.
Mr. Windes reiterated his motion, seconded by Mr. Parisot, to
adopt the proposed amendments to Chapters 1A and 2 of the LDC.

ORDINANCE NO. 12-24
PUBLIC HEARING - AMENDING CHAPTER 9 OF LAND DEVELOPMENT CODE,
ABANDONED VEHICLES, BOATS AND/OR TRAILERS (9:00 A.M.)
Mr. Stanford read the advertised legal notice for public hearing
to consider changes to the LDC as submitted by the Growth
Management Department. These changes are to revise Chapter 9
Operational Performance Standards regarding the definition of an
abandoned and nuisance vehicle, boat or trailer. This is the
November 20, 2012 -12- Minute Book 68, Page 57
Okaloosa County Board of County Commissioners
second hearing. The first hearing was held on November 6, 2012
in Crestview.
Mr. Kampert provided the following background and _ staff
commentary:
e Under the definition of an abandoned vehicle provided in
Section 9.03.01.1, vehicles on car dealer lots, repair
yards and other accepted and otherwise legal areas, would
be considered abandoned. The proposed change corrects this
oversight by recognizing various uses at which unlicensed
vehicles may be kept.
e Section 9.03.12.2 does not allow the common practice of
leaving vehicles with relatives or friends while away (e.g.
service men and women leaving vehicles with relatives while
deployed or students leaving a car with parents while at
school) unless the vehicle has a current tag or in a garage
or carport if not being used. Also, a vehicle without a
current tag cannot be kept behind an opaque privacy fence
even if it is in perfect running order. The amendment
clarifies the conditions under which vehicles without tags
may be kept on properties without creating a nuisance.
e As the subject matter deals with storage of vehicles and
does not provide standards for the development of property,
it is not clear why it was included in the LDC. The
subject matter would be more appropriately located under
“Traffic and Motor Vehicles.” Staff recommended including
the subject in a new Article III of Chapter 21 of the
“County Code.” It would follow Article II on stopping,
standing and parking.
e Inclusion of abandoned vehicles within the LDC has created
confusion as to enforcement authority. Under the proposed
new article, the responsibility would clearly rest with the
Sheriff'‘s office.
Mr. Kampert stated Mr. Boyles has requested consideration for an
exemption for large tracts of agriculturally zoned land outside
the Urban Development Boundaries. He advised that staff has no
objections.
Mr. Amunds stated this is the first the Board has heard of this
suggestion. He commented that he believes in consistency and
said as former law enforcement officer, consistency with the law
is important.
November 20, 2012 -13- Minute Book 68, Page 58
Okaloosa County Board of County Commissioners
Mr. Harris stated these are living documents and he has no
Opposition to Mr. Boyles’ recommended change. However, he said
how will the determination be made, asking if a five-acre lot in
Holt would allow for someone to put an old car up on blocks.
Mr. Harris stated this could be problematic.
Mr. Amunds asked Mr. Boyles to pitch his idea. Mr. Boyles
explained that when he read the proposed ordinance he developed
concerns about nuisance vehicles. He said he understands the
purpose of the ordinance is to correct deficiencies in existing
conditions. Mr. Boyles cited examples. He stated that he has a
camper he intends to renovate but it is not registered. Across
the road, he can see an old Chevy in a neighbor’s barn. Mr.
Boyles stated this standard applies more to urban area. He
advised that he is not tied to this implementation but cannot
support the draft ordinance.
Mr. Kampert pointed out Code Enforcement will enforce whatever
policies the Board adopts. Mr. Amunds asked if another hearing
is required to consider this change. Mr. Kampert replied in
the negative. He said the ordinance would be revised to include
language saying the nuisance vehicle requirements would not
apply to agriculturally zone properties outside the urban
boundaries. Mr. Windes stated Mr. Boyles makes a good point,
noting the diversity of our county. Mr. Parisot made motion,
seconded by Mr. Boyles, to adopt the ordinance with an amendment
exempting the nuisance vehicle requirements for properties with
agricultural zoning and are outside the Urban Development
Boundaries. 5 yeas.

WATER & SEWER - LEASE AGREEMENT WITH SKYETECH, LLC
Mr. Littrell requested approval of a lease agreement with
Natalie and Jeff Hendricks II of Skyetech LLC for lease of an
Okaloosa County Water & Sewer owned building at 1310D Oddfellow
Road in Fort Walton Beach. He also asked for approval of a
resolution authorizing lease of the property. Mr. Parisot noted
that Skyetech’s insurance coverage does not list Okaloosa County
as additional insured. Mr. Parisot made motion, seconded by Mr.
Boyles, to approve the resolution and lease agreement with the
stipulation Okaloosa County is added to the insurance policy.

WATER & SEWER -— AMENDMENT TO INTERLOCAL AGREEMENT AND SALE
AGREEMENT WITH CITY OF NICEVILLE FOR RECLAIMED WATER SERVICES
FACILITIES
Mr. Littrell requested approval of an amendment to the
Interlocal Agreement and Sale Agreement (and associated
documents) with the City of Niceville for transfer of the
reclaimed water facilities. He advised Okaloosa County is no
longer part of the NVOC Regional Sewer Board. The Niceville
City Council unanimously approved the documents on November 13,
2012. Mr. Windes made motion, seconded by Mr. Harris, to
approve the department head’s recommendation. 4 yeas, 1 nay.

PUBLIC WORKS ~ STEPPING STONES AT SURF DWELLER CONDOMINIUM
Mr. John Hofstad, Public Works Director, stated a request has
been received from Jan Heisterman, owner of a unit within the
Surf Dweller Condominium, to reinstall 12-inch diameter stepping
stones on county property on the south side of the complex. The
stepping stones were originally installed in 1983 by the
contractor to provide unobstructed travel for the ground units
to the beach walkover. The stones were removed for Hurricane
Ivan in September 2004. They were replaced in April 2012 but
after being replaced, Florida Department of Environmental
Protection (FDEP) received a complaint and FDEP required the
stones to be removed.
Mr. Hofstad advised that staff has discussed this issue with Ms.
Heisterman and FDEP. FDEP recognizes the area where the
stepping stones are to be placed is county property and will
require approval by Okaloosa County and a written request from
the Surf Dweller Condo Association. He advised that the Public
Works Department supplied FDEP with a letter of approval on
October 8, 2012 but he does not believe the Condo Association
has considered the item.
Mr. Hofstad provided a number of slides of ground unit patios,
county property and the dune walkover. He reported receiving a
number of emails, both for and against the request.
Consequently, staff felt it should present this issue to the
Board for direction. Mr. Amunds commented if the stones are
replaced, they should be recessed to avoid tripping hazards.
Mr. Dave Sherry stated he is not currently on the Board of
Directors for Surf Dweller but he is speaking on behalf of his

Okaloosa County Board of County Commissioners
wife, Sherry, who could not be present. He said Ms. Heisterman
is not requesting approval to install the steps herself but
seeking for the Condo Association to install the stepping stones
along the entire length of the complex at the expense of the
other condo owners. Mr. Harris asked what the big objection is
to this request. Mr. Sherry replied it is potential damage to
the vegetation. Mr. Harris pointed out people would be walking
on the vegetation anyway. Mr. Sherry said ground unit owners
can go out their front doors and through the breezeway to get to
the dune walkover to the beach. Discussion ensued about the
partitions and patios on the ground floor units. Mr. Harris
commented we appear to be making a mountain out of an ant hill
about this.
Mr. Windes suggested the Surf Dweller homeowners association
decide what they want to do as a body and the Board could go
along with that decision. Mr. Dowd stated that would be
authorizing people to build on public property. He also cited
liability concerns about people tripping over the stepping
stones.
Mr. Brance Parker, Vice President of Surf Dweller Board, stated
he agrees with Mr. Harris on this. He said the contractor
installed the pavers to provide a logical flow to the dune
walkover. Mr. Parker stated the first floor unit owners are
going to take the quickest egress to the dune walkover. He
pointed out people are going to walk this path whether the
pavers are there or not. Mr. Parker commented that the stepping
stones are stored on site, Saying this was never an issue
before,
Mr. Harris made motion, seconded by Mr. Parisot, to approve
placement of the stepping stones. Mr. Boyles stated this issue
should not have been on the agenda and staff should have made
the decision. He added the request should come from the
condominium association and not an individual. Mr. Curry said
he would like to clarify that the Public Works Director did make
the decision but felt it was important to have the Board uphold
his actions. 5 yeas.

PUBLIC WORKS - RECOMMENDATION TO AWARD BID AND EXECUTE CONTRACT
FOR BEACH CONCESSION SERVICES
Mr. Hofstad recommended the bid for beach concession services be
awarded to Island Sands Beach Service of NW Florida, LLC as
highest bidder meeting specifications with an annual bid of
$30,000. He also requested the Chairman be authorized to
execute the contract. Mr. Harris made motion, seconded by Mr.
Parisot, to award the bid to Island Sands Beach Service and to
authorize the Chairman to execute the contract. 5 yeas.
PUBLIC WORKS - INFORMATIONAL ITEM REGARDING PAYMENT TO GULF
COAST TRAFFIC ENGINEERS FOR ROAD STRIPING
The final invoice for road striping for FY 2011-12 in the amount
of $379,905.39 has been presented by the vendor for review and
payment. The work has been field verified and staff agrees with
the work which has been completed. Sufficient dollars remaining
in the FY 2011-12 budget to pay the total amount of the invoice.
Due to the timing of the approved striping list and the
contractor’s workload, not all of the list was completed. Those
roads remaining on the 11ist will be completed in FY 2012-13.
Gulf Coast Traffic Engineers was approved as the low bidder for
road striping projects for FY 2012-13. Mr. Parisot made motion,
seconded by Mr. Boyles, to approve the explanation. 5 yeas.
PUBLIC WORKS - INFORMATION ITEM REGARDING EXPANSION OF EBNHANCED
RECYCLING SERVICE
Mr. Hofstad stated currently the county has a 2-1-1 program (two
trash, 1 recycling, 1 yard waste pickups per week). A pilot
program for enhanced recycling services (referred to as 1-1-1
program) has run since February in the Shalimar area. He termed
the pilot project as “largely successful.” Mr. Harris noted
only 20% of the the pilot program participants responded to the
survey. Mr. Hofstad stated the majority of those responding
were in favor or supportive.
November 20, 2012 -17- Minute Book 68, Page 62
Okaloosa County Board of County Commissioners
Mr. Hofstad reported staff is currently working with Waste
Management about restructuring an amendment to the contract that
would be in the best long-term interest for citizens. He
advised Waste Management wants additional time to review the
data. Mr. Hofstad was hopeful that he could bring back
additional information by the second meeting in December and
this item could be resolved once and for all.
Mr. Amunds asked a series of questions:
1. How much additional revenue will be brought in if the
program is implemented countywide?
2. Can that revenue be used to offset the purchase of the
trashcans?
3. Will there be a reduction in rates?
4. Are there options for citizens who would have trouble with
moving the larger trashcans around?
Mr. Hofstad stated residents can notify Waste Management if they
have problems and arrangements can be made for the drivers to
provide assistance.
Mr. Parisot made motion, seconded by Mr. Boyles for discussion,
to extend the pilot program in the Shalimar area until the end
of December. Mr. Boyles noted this issue is not as simple as
comparing apples to apples. The disposal of garbage is a
regional issue. The vote was taken on the motion to extend the
enhanced recycling pilot program in Shalimar until the end of
December—5 yeas.
OLD BUSINESS - VOLUNTEER DUNE PLANTING
Mr. Dave Sherry, Okaloosa Island, stated the Volunteer Dune
Planting event held earlier this year was the biggest yet,
planting 20,000 sea oats. He said they hope to expand the 2013
event and plant 100,000 sea oats. Mr. Sherry stated sponsors
are already signing up and their group has applied for a NRDA
grant. Efforts are being made to coordinate with the county’s
Okaloosa Island Dune Flora Restoration Project. He said if
$40,000 in bed tax dollars can be contributed for the purchase
of these 100,000 plants, the volunteers will be able to plant 1%
miles on Okaloosa Island. Mr. Sherry said the condo alliance
would provide the labor and permit for free.
Mr. Sherry said he and his wife met with county staff and
consulting engineer and they are concerned about volunteers
being on the dunes after the county project is completed.
November 20, 2012 -18- Minute Book 68, Page 63
Okaloosa County Board of County Commissioners
Likewise, they are concerned if the volunteer event occurs prior
to commencement of the county project there could be damage by
the contractor employees stepping on the sea oats planted by the
volunteers. Mr. Sherry advised they could lose their sponsors
if they stop now and if the plants are damaged by the
contractor, it is a chance they will have to take.
Continuing, Mr. Sherry said another concern is the county
project has been delayed until April or May 2013. He felt this
is late for planting and stated the turtle nesting season begins
May 1. Mr. Sherry stated they do not want to be the cause for
delaying the county project. He said the issue is whether or
not the county wants to make TDC funds available for the
purchase of the sea oats.
Mr. Amunds stated the county does want to encourage volunteers
and said perhaps there is a way for the contract to carve out an
area for them to plant. He said the county is not just going to
hand over $40,000 to the condo alliance and any distribution of
county funds would have to go through the purchasing process.
Mr. Sherry replied it was their intent to go through Purchasing
Department and the county could send the check directly to the
supplier.
Mr. Parisot expressed concern about going from Seaspray
Condominium to El Matador. He said the first option is not to
have the volunteer planting in 2013. Mr. Parisot stated if a
section of the project is carved out for volunteer planting,
then a letter should be received from those beachfront
properties saying they want the volunteer planting. He pointed
out the plants to be used by the volunteers are inferior in size
to the ones to be purchased for the county project.
Mr. Jim Trifilio, Coastal Management Coordinator, stressed that
staff would never be against any volunteer efforts. He said the
Coastal Engineer for the project would have to sign off on the
engineering design and this could cause a delay in the county’s
Dune Flora Restoration Project. Mr. Trifilio also cited concern
about the use of inferior plants.
Mr. Matt Trammel, coastal engineer with Taylor Engineering,
advised there are a number of issues. He said he is tasked with
developing contract drawings and carving out a section to be
planted with inferior plants will increase the difficulty of the
job for the contractor. This could lead to an increase in costs
and time for the project. Setting aside portions for volunteer
November 20, 2012 -19- Minute Book 68, Page 64
Okaloosa County Board of County Commissioners
planting would require additional surveys, pre-construction
meetings, and time to flag off those areas. Mr. Trammel stated
it would be necessary to verify the volunteer plantings were
done according to specifications before the contractor comes out
and plants. He said, “I must certify. We are looking at more
work.”
Mr. Amunds asked Mr. Trammel for his recommendation. Mr.
Trammel said they want to provide an opportunity for everyone.
He said perhaps the volunteers could supplement the contractor
by doing plantings on the upland areas.
Mr. Harris stated it 1s great the volunteers want to provide
this assistance but pointed out the jeopardy it puts on the
engineer because he must sign off on the work. Mr. Amunds noted
the Board must provide direction and he feels the state-funded
project should be the priority. Mr. Harris concurred that the
professionals should do the work. Mr. Boyles added the
volunteer planting event is noble but the $1 Million project
needs to move on unimpeded. He said perhaps funds can be made
available in 2014 for the volunteer event. Mr. Parisot stated
he fully agrees with Mr. Boyles, saying we do not need to do
anything to delay this State/County partnership. Mr. Windes
echoed Mr. Parisot's comments. Mr. Curry confirmed the
Girection of the Board is for the county to proceed with the
county project and work with the volunteers for an after-project
event.
PUBLIC COMMENTARY
Mr. Brance Parker commended the volunteers desiring to assist
with the dune planting but said the risks could throw the
project into disarray. He felt delaying the volunteer planting
event wasS appropriate.
Mr. Trip Tolbert stated his issues regarding the volunteer
plantings were addressed during the discussion. He welcomed Mr.
Boyles and Mr. Windes and said he believes this will be one of
the best functioning Boards the county has ever had.
