BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: February 19, 2013 TO: Honorable Chairman and Members of the Board FROM: Elliot Kampert SUBJECT: Public Hearing - Panhandle Nursing Care FLUM/Zoning Amendment DEPARTMENT: Growth Management BCC DISTRICT: Two ISSUE: Consideration of a request changing the use of land submitted by Choctaw Engineering as agent for Panhandle Nursing Care, Inc. relating to property located at 1 LBJ Sr. Drive, Ft. Walton Beach. The request is to change the Comprehensive Plan Future Land Use Map (FLUM) designation for the property from Medium Density Residential (MDR) to Mixed Use (MU), or a more restrictive FLUM designation. If the FLUM amendment is approved, request to rezone the property from Residential - 2 (R-2) district to Mixed Use (MU) district, or a more restrictive zoning district. Property contains 5.99 acres, more or less. STAFF FINDINGS: • The property is the site of an existing operational nursing care facility. • The current MDR FLUM designation and zoning does not allow the property to be used as a nursing care facility. • The owners would like to expand and remodel the existing building. • The requested MU FLUM change and rezoning would make the current use legally conforming and allow for the desired improvements. • The property is classified as “Homes for the aged” by the Property Appraiser for property tax purposes. • There are other mixed use-designated and zoned areas in the immediate vicinity. PUBLIC COMMENT/OPPOSITION: None to date. STAFF POSITION: Staff has no objection to the requested FLUM amendment and rezoning. PLANNING COMMISSION: The Planning Commission voted unanimously to recommend approval at a public hearing held January 10, 2013. MILITARY REPRESENTATIVE: No comment. RECOMMENDATION: It is recommended that the Board consider the facts presented herein, the Planning Commission recommendation, as well as any facts that may be presented at the public hearing, and then decide whether or not to adopt the FLUM amendment and rezoning by ordinance. RECOMMENDED BY: APPROVED BY: James D. Curry, County Administrator
