RA; Fernando F. Chaves, Case 99- 1095 REQUEST Rogelio Chaves is requesting that the lien on 300 Eglin Pkwy NE be reduced. BACKGROUND The subject property was found in violation of Sec. 20-322 Building Permits Required for failure to obtain permit before commencing with repairs and/ or replacement of a pole sign. The owner of the property has a history of eight code cases over the past ten years. This subject lien and request for reduction of said lien will be Mr. Chaves' second time to have accrued fines in excess of $50, 000.00 and thereafter made request to reduce such liens. The current lien was incurred through Orders of the Code Enforcement Board dated October 13, 1999 and November 10, 1999. Said Orders included $ 240.00 in administrative fee and a $ 100.00 per day fine that ran from October 29, 1999 through the compliance date of March 29, 2001. The accrued fee is $ 51, 940. 00 which includes the $240. 00 administrative fee. DISCUSSION The subject case went through the entire Code Enforcement process including referral of the case to the City Attorney' s office for foreclosure action due to lack of compliance and was only brought into compliance after threat of foreclosure. Mr. Chaves' current request was prompted when he was attempting to refinance the property and a title search revealed the City' s lien. RECOMMENDATION: Staff recommends that Mr. Chaves' request to remove the lien be approved with the condition he pays $ 5, 000.00. Staff is requesting $ 5, 000 be paid because of the history of violations on Mr. Chaves' properties. It is stated in such document that fines have been applied due to non- compliant with building permits as indicated by the city of Fort Walton Beach. I would like to request the city council reduce the lien on such property. Said property has been compliant since march 29, 2001.
