of the Code is attached. DISCUSSION: There are presently two vacancies on the Historic Sites and Structures Advisory Board: unexuired term until May 13. 2006, and a four-year term. Earl Mitchell, 229 Alconese Avenue SE, resigned from the Historic Sites Board on November 1, 2005. Since his term expired on March 11, 2006, his vacancy constitutes a four-year term. Sites Board. A Tourey Guarino, 35 Pryor Road SE, failed to maintain attendance on the Historic letter was sent notifying her that a vacancy has occurred and is authorization for Council to appoint a replacement. The term ends May 13. 2006. At anytime Council may submit a nominee for consideration and an application must be filled out prior to an appointment. Membership is not limited to City residents. The terms of members of the code enforcement board shall be limited to not more than two successive three- year terms, or parts thereof consisting of two or more years of an unexpired term. 2. 02. 04 Dual Office Holdino Prohibited No person, excluding the mayor, council members and employees of the city, shall serve simultaneously as a member of more than one agency, authority, board, commission or committee of the city: Upon appointment of a person, subject to this limitation, to an agency, authority, board, commission or committee, such new appointment shall effect the termination of that member's term as a member of the agency, authority, board, commission or committee on which he previously served. 2. 02. 05 Vacancies Vacancies on any agency, authority, board, commission or committee shall occur when a member fails to attend three successive regular meetings or a total of four regular meetings or five special meetings within any 12- month period. It shall be the duty of the city clerk to report the lack of attendance to the council. The report of the city clerk, with a certificate of mailing notice to the absentee member, shall constitute evidence that the vacancy has occurred and shall be authorization for the council to appoint another member for the unexpired term. 2.02.06 Notice of Misconduct: Action bv Council A majority of the members of any agency, authority, board, commission or committee may report to the council any member of such agency, authority, board, commission or committee who has committed misconduct, indiscretion or other activities which deal with the competency or qualifications of any member of such agency, authority, board, commission or committee, or who, for health reasons, may be unable to continue to serve. Upon the receipt of such notice, the council, after notice to such member, may hold hearings to determine whether such conduct is sufficient to remove the member from the member's appointment. Should the council determine that the member has committed the conduct as specified or is unable, for health reasons, to continue service, it shall determine that a vacancy has occurred in such appointment. 2. 02.06 Information Reouired of Candidates for Acoointment Any candidate for appointment or reappointment to an agency, authority, board, commission or committee shall file with the city clerk his or her name, residence address, mailing address, occupation and any other pertinent information. The city clerk shall maintain a file of candidate applicant forms for future reference.
