3. Existing zoning boundaries are
illogically drawn in relation to existing conditions
on the property proposed for change. .
Existing zoning boundaries are not drawn consistent with the Comprehensive Plan
Future Land Use Map. The proposed change implements the Future Land Use
IIap
FLUM]designation NfUCC Mixed Use Community Commercial. The request Is
considered appropriate and consistent wlfh fhe Comprehensive Plan.
4. Changing or changed conditions make the proposed
zoning appropriate.
Tbe following events have occuned since 2<<
10 when fhe Future Land Use Map
FLUM) was adopted: 1) the FLUM caned for substanflal changes in the area
along Hollywood Boulevard SE and SW as weB as Seal Parlcwayfrom C,
Commercial (now called General Commercial)to MUCC (1KlX. ed Use Community
Commen:ial). All C-1 and C-2 aR!aS along Hollywood and Seal
Padcway weB to be
de- Intensified commerciaHyto anow residential and commercial mixed uses (not
allow auto repair,auto sales,etc. uses);2) business and
property 0WIJe1S objected
to the re- cfassNlcation when the City began to implement the zoning
chang,.
requiJed from C- 1fC.2 10 MUCC- 1/AJUCC- 2 and City Council denied tbe zoning
changes; and 3} Staffinftiated a change to the FLUM to General Commercial in
2tJ03. The teSult is that C-
1 and C-
2 zoned areas and Land Uses are called out for
the Hollywood Boulevard corridor rather than the Mixed Use
Community
CommerciaL Therefore a change in intensity of land use to mixed-use makes more
sense. City Council agreed and
chang.ed the FLUM to MUCC in July 2005.
5. The proposed change Will adversely influence
tivtng conditions in the neighborhood.
Any adverse conditions that may have been created by the development of the
commercially zoned property along the Hollywood Corridor should be amerlOrated
by the MUCC-2 zoning proposed by the request. See
( Zoning Map-Exhibit B).
6. The proposed change will create or excessively increase traffic
congestion or
otherwise effect public safety.
The request site will be accessed from Parle Circle SE a local street
7. The proposed change will create a
drainage problem.
There are no known soil types in the area that might create
dminage problems on
the site.Any development on the site will require a stormwater
plan per LDC
regulations. The intensity of deve/ t and percentage of impervious surface
opm.,
will be limited to 75 per cent of the site.
8. The proposed change will seriously reduce light and air to
adjacent areas.
The bulle development standards for the AfUCc-Z District are less restrictive than
the comparable R-2 District (see table below)fo accommodate a mix of commercial
and teSidential use. Heights Wl11 continue to be limited to 45 feet

9. The proposed change wilf adversely affect property values in the adjacent areas.
staff does not anticipate anyadvetSe affect on property values from the proposed
to the west of
change as there is a ftansitionallflUCC land use designllfion in place
the request.
10. The proposed zoning change win be a deterrent to the improvement or development
of adjacent property in accordance with existing regulations.
The rezoning should stimulate re- devefopmenf of adjacent developed siteS as well
as the request site. The existing R-NC zoning is inappropriate
and being phased
out City-wiclf!.
11. The proposed zoning district win constitute a grant of speciar privilege to individual
owners as contrasted to the public welfare.
6
The requested change in zoning does not represent a grant of special privilege. As
previously mentione4 applicant is talcing action which will implement a change in
the FLUNI, that the City would otherwise have to accomplish.
12. There are substantial reasons why a reasonable use of the property can not be
accompfished under the existing zoning.
This property ;s su" ounded to the notfh~east and west by lands designated
General CommerciaL Continued use as residential wiR create {and use contJicts
with those mote intense lands. This land has designated for commercial use from
since the Year 2000.
13. Whether the zoning proposed is out of scare with the needs of the neighborhood or
the City.
The proposed zoning change to MUCC-2 implements the Comprehensive Plan
FLUM designation for the request site.
F. SUMMARY
The proposed change win implement the FLUM designation Mixed Use Community Commercial
by changing the zoning to a district considered consistent with that designation, MUCC-2 Mixed
Use Community Commerciat-2 District
