When Resolution 07 -01 was recorded in the Official Records at the Okaloosa County Clerk of Court' s office, a lien was levied against all properties referenced in the resolution. Property owners were given the option of paying in full at the time of the assessment or paying the assessment in twenty annual installments at 5% interest, with no prepayment penalty. Discussion Two property owners paid the assessment in full in February 2007 and the City has an obligation to release the liens on those properties. WHEREAS, the City Council of Fort Walton Beach passed Resolutions 05 -13, 05 -32 and 05 -34 determining public improvement by special assessment; declaring water, sanitary sewer, street and drainage improvements on Stokes Avenue in the City of Fort Walton Beach; and WHEREAS, a Public Hearing was properly advertised and held before the City Council on October 25, 2005; and WHEREAS, following the Public Hearing the City Council met as an Equalizing Board to hear and consider any and all complaints as to the special assessments and so adjusted and equalized the assessments on a basis of justice and right; and WHEREAS, the City Council approved the total public improvement special assessment of 222,049. 82 maybe paid in twenty (2G) equal annual installments at an interest rate of five percent 5 %) per annum; and WHEREAS, installation and construction of said improvements have been completed and the Final Assessment Roll, as approved in Resolution 05 -34, has been revised crediting each of the assessments, where less than the original assessment, the difference in the assessment as originally made, approved and confirmed and the proportionate part of the actual cost of the improvements to be paid by special assessments as finally determined upon the completion of the improvements.
