We are actively marketing and developing the project, but will not be able to provide all of the information necessary to obtain a building permit by that date. The continuing economic crisis has affected the availability of funding for the project, requiring us to seek alternative financing and investors. In addition, the office and residential condominium market decline, and escalating construction costs, have required us to re- examine the project configuration. These :factors are adding additional time and effort to the building permitting process. Accordingly, we request that the City provide us with a 12 -month extension to apply for a building permit. With the extension, we will be able to provide the City with a more complete package of construction documents. This will enhance the quality of the project and reduce the amount of City staff time needed for document review and revision. Thank you for your assistance. Please let me know if you need any additional information for this request. Sincerely, MichaeCH. NEW BUSINESS -EXTENSION REQUESTS The City Attorney gave the oath to those who planned to testify. ALTAVISTA CONDOMINIUM EXTENSION, 220 MIRACLE STRIP PARKWAY Consideration of a recommendation of a 12 -month extension of the Development Order for Altavista Condominium located at 220 Miracle Strip Parkway SW. Christy Johnson, Planner, advised the project consists of a nine -floor building which will include office space on the first three floors and resort residential condominium units on the top six floors. Ms. Johnson continued that the Development Order was originally approved by City Council on March 28, 2006; the order was extended on March 7, 2007, and March 25, 2008, and Staff recommends approval of an extension through March 25, 2010. Ms. Johnson informed that the project meets the new adopted code except for the height, which is 92. 6 feet, and 70 feet is currently allowed. The Staff Report was entered and accepted into the record. Mike Crew, Crews Investments, representing the applicant, advised that during this economic time, it is difficult for any developer to obtain financing, and even if they did, the market is slow and developments are difficult to sell. Mr. Crew discussed a bill being considered by the Senate Select Committee which would automatically renew developments for three years, although it is not yet in place to help his current situation. Mr. Crew mentioned he recently constructed a small two -story office building on Highway 98 for his employees, and he is finding it difficult to lease the second floor of an office building on the main street of the city. Page lof 5 7- 03/ 04/ 09 ALTAVISTA EXTENSION REQUEST ( CONT) Mr. Crew requested additional time for him to build a quality project in the City at a time when the economy in the entire country improves. Discussion ensued regarding continually giving extensions on development orders and to ensure that a project is not out of date by the time the project is ready to be developed; and that an applicant has a right to request an extension as often as is needed, but the Board can accept, deny, or request modifications to a project. The Chairman asked for public input. There was none. Mr. Reed moved to recommend a 12 -month extension of the Development Order for Altavista Condominium located at 220 Miracle Strip Parkway SW. Ms. Klement seconded motion. Board discussion ensued regarding having stipulations that a project extension conform to current standards; the need for the City to be developer friendly and for the Board not make it difficult for builders to go through the process; that the country is in a ` credit crunch' and it is important to work with developers to ensure they can progress with their project when the market turns around; and that when the economy improves and a project is ready to begin construction, that the site plans and schematics be reviewed to ensure they are in line with the current standards in a way that will not unduly burden the developer. The Chairman called for the vote on the motion and it carried unanimously with Covey, Gossom, Kennedy, Klement, Legg, Nabors, and Reed in
