14. ACTION - DIRECTION --DISCUSSION
1. City Attorney Position
Synopsis: Discussion and direction to the City Manager on the in-house, part-time City Attorney
position.
The City Manager advised that a job description and a budget has been developed for a part- time
in -house city attorney, that the advertising requirements have been completed, and that 11
applications have been received. The City Manager stated he is seeking direction from Council
on the process to follow for the interview and selection process.
The City Manager stated for the record that this in no way is a reflection on the performance of
the current city attorney or the firm; rather, it is a money saving issue.
Dr. gossom suggested establishing a search committee utilizing the resources of City staff
including the Administrative Services Director to chair the search committee, and include the
Finance and Engineering Services Directors or their designees, to interview the applicants and
recommend to Council three to five of the most qualified applicants.
Mr. Goodwin stated hesitation with delegating that much of a Council function to the City's
administration, and suggested Council shortlist the applicants and allow Staff to do in -depth
interviews and report back to Council the most qualified applicants.
Discussion also included having a qualified member of Council to serve on that committee as
well; particularly Mr. Goodwin as he is a practicing attorney.
Consensus of Council is to establish a search committee utilizing appropriate staff along with a
qualified member of the Council to shortlist the applicants to five and report back to Council the
most qualified applicants to interview.

Historic Sites and Structures Advisory Board
Discussion and Direction regarding the Historic Sites and Structures Advisory Board.
The City Manager presented background information on the creation and role of the Historic
Sites and Structures Advisory Board ( HSSAB) and noted that the Board currently has four
members out of seven seats, and the last three of five meetings did not have a quorum. /
He further explained that since the Municipal Planing Board (MPB) has the duty to monitor t, e
Land Development Code ( LDC) and the LDC contains an historic preservation section with rule
and regulations designed to protect such sites, and it is duplicative and redundant to have a Board
that does the same thing. Therefore, it was recommended that the HSSAB be sunsetted.
The City Manager confirmed that the MPB can be the repository of the Certified Local
Government ( CLG) designation, which was formally the responsibility of the HSSAB.
The vote on the motion to sunset the Historic Sites and Advisory Board as of March 13,
2012, carried unanimously.

15. CITY MANAGER REPORTS
1. Police Department - Status Update
Synopsis: The City Manager will provide an update to Council on the progress of the review of
the Sheriffs proposal to provide law enforcement services to the City.
The City Manager stated the Police Chief has informed him that his review of the Statement of
Work for police services will be completed on March 19 and will be turned over to the Finance
Department for evaluation and analysis. He continued that several issues have been identified
that are problematic in the analysis, most importantly the evaluation of the Police Pension, which
is a major piece of the financial part of this issue. The City Manager informed an actuarial
review would need to be done at a cost of $20, 000 and stated he does not have that spending
authority.
The City Manager further advised that per the direction of Council the City Attorney has sent a
request to the Florida Department of Ethics for a final opinion whether a conflict of interest
exists regarding Mr. Griggs and the police consolidation issue. The City Attorney informed the
Commission will not be meeting until the end of March so he does not expect a response until
mid -April.
The City Manager emphasized he wants to ensure Council has all the necessary facts and
information before he sets a date for a special meeting and requested Council direction.
Discussion ensued regarding whether the Police Pension Plan could be converted to a defined
contribution pension plan as was done with the General Employees Pension Plan. Brandy Ferris,
Finance Director, advised the Police Pension Plan is protected under Chapter185 and Council
cannot make any changes to that plan.
A lengthy discussion was held regarding the proposed plan by the Governmental Accounting
Standards Board ( GASB) whereby municipalities would declare pension projections as a liability
on their financial statements, which would give the appearance that a municipalities liabilities are
greater than their assets and would prevent cities from borrowing in the future for any purpose.
The City Manager stated the issues of pensions are very deep and discussions will be held in
April to ensure Council has a full understanding of the issue before the budget workshops.
Dr. gossom stated her thoughts of the importance of having vacant or unused property within the
City back into the tax rolls to generate revenue and add to the base in the city. She discussed the
need to look long term and take the assets the City has and utilize and leverage them for financial
responsibility.
