City Manager and the new
agreement allows the City to cancel the contract with 30 days written notice, without penalty,
and allows the City Attorney to cancel with 90 days written notice without penalty. The City
Attorney further advised the other change is an increase in the hourly rate from $ 160.00 to
170.00 for attorney fees and from $ 50. 00 to $ 60. 00 for legal assistants. He noted these fees are
comparable to what city attorneys in other jurisdictions make.
Council discussion included establishing an evaluation process so charter officers are evaluated
on an annual basis. Council also expressed concern with the proposed increase in fees, stating
this is not the time for increases as City employees have not had a raise in five years, and that

Telemetry System Upgrade for Radio Narrow -Banding Sole Source
Tim Bolduc, Engineering/Utility Services Director, explained the equipment the City uses for all
lift station telemetry is no longer in production and what is left has deteriorated. While
evaluating the most cost effective method to replace the equipment, Staff determined that
converting to the new Telemetry Control Unit ( TCU) for all lift stations would be more fiscally
responsible than investing in an obsolete system.

Discussion of Options to Fill the Future Vacancy for City Council Seat 3 L
Staff will present the options for filling the future vacancy in City Council Seat 3 and request
City Council direction to determine the procedures to fill the vacancy.
Michael Beedie, City Manager, advised the City Charter states if a vacancy on Council is created
more than 60 days from the date of the primary election, Council shall fill the vacancy. He
continued the requirements are that nominations be made to fill the seat at two regular meetings
following the vacancy, and the appointment be made at the third regular meeting, whereby the
person will sit on Council until the end of March.
Mr. Beedie reported that Mr. Reeves is vacating his seat on November 16, which is more than 60
days before the election, and if the second meetings in November and December are cancelled,
an appointment would be made at the second meeting in January.
Mr. Beedie stated this information was provided to Council so they can determine their winter
schedule.
