GROWTH MANAGEMENT - SUBMITTAL OF HAZARD MITIGATION GRANT APPLICATION ON BEHALF OF BLUEWATER BAY MSBU Mr. Elliot Kampert, Growth Management Director, stated a request has been made for the county to file an application with the Florida Department of Emergency Management (FDEM) on behalf of December 16, 2014 -6- Minute Book 72, Page 77 Okaloosa County Board of County Commissioners the Bluewater Bay Municipal Services Benefit Unit (MSBU) for funding to repair a stormwater system damaged during the April 2014 flooding event. Application to the Hazard Mitigation Grant Program is limited to local governments, Indian tribes, and non- profit agencies. It is for this reason the application must be submitted by the county. Mr. Kampert stated the estimated project costs are $399,465 and requires a 25% local match. He stated the county would provide in-kind match funds estimated at $83,366.25. Additionally, the MSBU would provide $6,500 and $5,000 each would be provided by Bluewater Bay Resort and the BWB Homeowners Association. The application deadline is January 6, 2015. Mr. Kampert stated because changes may occur regarding scope of project and the financial analysis, he will bring any changes back to the Board on January 6. It will be necessary to enter into an agreement formalizing the relationship and responsibilities of the county and the MSBU for administration of the grant. The agreement will be developed/prepared in the weeks following submission of the grant application. It was also pointed out the proposed project includes work in the county rights-of-way and easements maintained by the county. The Chairman is also asked to execute the Maintenance Agreement included in Section V of the subject application. Mr. Kampert stressed that submission of the application is not binding until the Board decides to sign the FDEM contract when it is sent back. Mr. Harris asked County Engineer Jason Autrey to come forward. Upon inquiry by Mr. Harris, Mr. Autrey stated the proposed Bluewater Bay project would impact the Public Works Department. He said if the MSBU buys the materials, county crews could do the work inside the county rights-of-way. He added “We are not sure how long the piece of string is” and we must maintain operations. Upon inguiry by Mr. Windes, Mr. Kampert answered there is no commitment with tonight’s decision. Mrs. Ketchel asked if the county’s $83,000 contribution could be replaced with BP money. Mr. Lee Lewis with AVCON replied "absolutely,” saying they looked at the RESTORE Act as a possible funding source. He said they prepared a conservative budget which could be scaled back if necessary. Mr. Harris December 16, 2014 -7- Minute Book 72, Page 78 Okaloosa County Board of County Commissioners stated it is his understanding the county’s contribution is for in-kind services. Mr. Windes remarked that is not set in stone yvet. Mr. Boyles made motion, seconded by Mr. Harris, to approve the agenda request recommendation as written and ask the MSTU to seek additional funding sources to offset the county’s costs. 5 yeas. PUBLIC HEARING - REQUEST FROM SAMUEL VELEZ-CASTILLO TO REZONE .44 ACRE ON NAVY STREET IN FORT WALTON BEACH FROM R-2 DISTRICT TO MHP DISTRICT Mr. Stanford read the advertised legal notice for public hearing to consider the request of Samuel Velez-Castillo to amend Ordinance No. 91-01 by rezoning .44 acre at 670 Navy Street in Fort Walton Beach from Residential-2 (R-2) district to Mobile Home Park (MHP) district. Mr. Stewart stated this 1is a quasi-judicial proceeding and anyone desiring to provide testimony should now stand and be sworn in. Mr. Stewart administered the oath to Growth Management Director Elliot Kampert. He then asked if the commissioners have any <conversations on this subject to disclose. There were no disclosures. Mr. Kampert said he would like to read the staff findings into the record: ¢ The subject property is located within the Medium Density Residential (MDR) future land use category. ¢ The MHP zoning district is intended to implement the MDR future land use category. e The requirements for the MHP zoning district are expressed at Section 2.06.00 of the Land Development Code (LDC). e Subsection 2.06.01 of the LDC sets forth the purpose of the MHP district as: The purpose of the Manufactured/Mobile Home Park (MHP) district 1s to provide areas for the location of manufactured and mobile homes where spaces are rented for the placement, parking or accommodation of five (5) or more homes. ¢ The purpose expressed above 1s taken from the definition found at Subsection 513.01, Florida Statutes, which reads: Mobile home park means a place set aside and offered by a person, for either direct or indirect remuneration of the December 16, 2014 -8- Minute Book 72, Page 79 Okaloosa County Board of County Commissioners Mr. owner, lessor, or operator of such place, for the parking, accommodation, or rental of five or more mobile homes. Subsection 2.06.07 of the LDC sets forth bulk regulations for the MHP district as: Regulations controlling MHP districts shall be the same as those prescribed at Chapter 64F-15, Florida Administrative Code. Rule 64E-15.002 of the Florida Administrative Code sets forth the minimum requirements for mobile home park spaces. (Each mobile home space designated for a single section mobile home shall contain a minimum of 2400 square feet with a minimum 35-foot width. Spaces for a double-wide mobile home shall contain no less than 3500 square feet with a minimum 50-foot width. All mobile home and lodging park spaces and their appurtenances shall be located a minimum of five (5) feet or more from exterior boundaries and from any body of water within the park.) Staff has determined that the site will accommodate five mobile home spaces within the minimum 35-foot width and 2400 square feet requirement for a single section mobile home. Comprehensive Plan Future Land Use Element Policy 4.4 requires consideration of compatibility as follows: Compatibility of adjacent zoning districts shall be considered during rezoning and land use plan amendments, considering potential maximum densities, intensities, and consistency of the potential land uses with surrounding districts, and the manner in which the land uses on the FLUM and the zoning districts result 1in an appropriate transition of uses, densities, and intensities. Policy 10.13 states: It is the intent of the County that the application of zoning districts for the implementation of the land use categories 1in this comprehensive plan provide for transition from more intense development to less intense development. Transition means that there is a gradual decrease in the allowable densities and intensities from one district to the next, with the most intense districts near municipal boundaries or areas of established intense urban develcpment. The consideration of the degree to which the zoning districts accomplish transition between land uses shall be part of the review process for land use plan amendments and changes to zoning. Kampert reported there has been no public comment or opposition; the Planning Commission voted unanimously to recommend approval at its hearing held on November 13, 2014; the December 16, 2014 -9- Minute Book 72, Page 80 Okaloosa County Board of County Commissioners military representative had no comment; and staff has no objections to the requested rezoning. Mr. Goodwin commented this property is in his district and in an area plagued with Dblight issues. He expressed concern and sought a comfort level that any action the Board takes will not add to the blight but reduce it. Mr. Kampert replied staff cannot guarantee that anyone will maintain their property. He added the proposed use will not contribute to blight. When the Chairman asked if there were any further comments, Mr. Velez-Castillo (petitioner) came forward. Mr. Stewart administered the oath to Mr. Velez-Castillo. Mr. Velez-Castillo stated he has other properties and they are “outstanding and neighbors welcome them.” He said he changes the 1look of everything and he is proud of his places. Mr. Velez-Castillo added that he believes this mobile home park will be an asset to the community. Mr. Goodwin made motion, seconded by Mr. Boyles, to adopt the ordinance to rezone the property as advertised. 5 vyeas. ORDINANCE NO. 14-17 FACILITIES MAINTENANCE - LEASE WITH OPPORTUNITY, INC. FOR SPACE IN OLD FORT WALTON BEACH HOSPITAL Mr. Don Turner, Facilities Maintenance Director, stated the Board heard a proposal at its October 7, 2014, meeting for consideration of two leased spaces in the old Fort Walton Beach Hospital. (NOTE: A portion of the facility has been leased to Elder Services and a second request was received from Opportunity, Inc.) He said the proposed lease with Opportunity, Inc. attached to the agenda request was incorrect. That document contained a term of three years with renewal options. Mr. Turner stated he has delivered a corrected document and a copy of the minutes for October 7 reflecting the Board’s action. (Motion from October 7: Mr. Parisot made motion, seconded by Mr. Amunds, to direct the County Attorney to prepare a lease with Opportunity, Inc. for the subject office space for a ten- year period at a lease rate of $1.00 per year. Mr. Parisot stated Opportunity, Inc. will be responsible for utility costs. 5 yeas.) December 16, 2014 -10- Minute Book 72, Page 81 Okaloosa County Board of County Commissioners Mrs. Ketchel advised that she has gone down to look at the facility and she is concerned about the state of the building and approving a ten-year lease. She suggested approval of a three-year lease with Opportunity and look at what should be done with the building in the long run. Mr. Boyles said he believes the concerns about the building are valid and the Board does need to look at global space planning. However, he stated an agency has made decisions Dbased on information previously provided to them. Mr. Boyles said he would hesitate to make any changes at this point. Mr. Goodwin shared that he too has concerns about the lease term, noting that he has not seen a 1long-term plan for this building. He reiterated a doubt about committing to a decade- long lease. Mr. Harris stated there has been much discussion about the old hospital over the years and suggested the new commissioners sit down with Mr. Turner to review the plans for that building. He said Opportunity really needs this building and does not feel they can get a return on their investment with a three-year lease term. Mr. Harris said the Board committed to ten years and he feels it would be wrong to change from ten years to three. Mrs. Ketchel said the organization might change its mind once it gets 1in the building. She stated “It’'s complicated.” Mrs. Ketchel repeated her support for a three-year lease term and to look at plans for the building. Mr. Hofstad stated the lease with Opportunity would be for only a portion of the remodeled space. He explained which portion of the building would be for Elder Services and which space would be allocated to Opportunity. Mr. Boyles asked what does this do to fulfill the Board's obligations. He noted that much money is spent on housing inmates but we do not have money to hand out for not-for-profit organizations. Mr. Boyles said what we do have is surplus space which can be used. Mr. Boyles made motion, seconded by Mr. Harris, to approve the amended version of the lease with Opportunity, Inc. for a ten-year term. Mr. Windes commented that he cannot support going back on the deal the Board previously made. December 16, 2014
