Dear Len,
Below, you will find the responses to the deficiencies noted by Malcolm
Foley upon his
review of the above mentioned project on May 15, 2006 and referenced in his attached
letter. The responses are in order and correspond directly to his
report ( see attached).
1. The owner ( Mary Alice Tucker), will be leasing the property to The Boat Marina,
therefore a cross access easement is not necessary. A full copy of the lease shall
be provided by the owner or owner' s attorney upon or before final
approval. A
new survey of the property undertaken and signed &
was sealed drawing
documents were provided upon last review (May 9, 2006).

6. No sign shall be submitted since it exists on the adjacent
property.
7. A 10' boardwalk easement is shown on attached sheet A- 1.0. Easement
documentation shall be provided by the City or Owner' s Attorney and recorded
upon final approval of Conditional Use Request. Easement for City ofFWB Lift
Station access is attached.
