Packet Pg. 10 City Council of Fort Walton Beach 0 To: CITY MANAGER MEMORANDUM Robert T. Meams, City Manager From: Carole Jones, Executive Assistant Date: September 21, 2011 Subject: Location of possible homeless shelter /center SIGNATURE BLOCK: Carole Jones Completed 09/ 14/ 20112: 28 PM Carole Jones Completed 09/ 14/ 20112: 28 PM City Manager Completed 09/ 14/ 20112: 28 PM City Council Pending 1. 1. 1. At the September 13, 2011 City Council meeting, Council directed Staff to gather information to determine if a " homeless facility" would be permitted at 112 & 114 Ready Avenue NW in the Commerce and Technology Park, which staff understands will include housing ( for a period exceeding 24 hours), food service, and personal services for adults. 2. DISCUSSION: 2. 1. The property located at 112 & 114 Ready Avenue NW is currently zoned M -2 Industrial Park) and the Future Land Use designation for the property is ( IND) Industrial. 2.2. The Comprehensive Plan describes the use of properties in the IND designation as follows, " the industrial ( IND) land use category is intended for activities that may include indoor or outdoor storage or activity, manufacturing processes, and may have impacts from noise, lights, or high levels of truck traffic. This land use category prohibits commercial activities such as retail or service uses. The category allows offices only as ancillary uses to the industrial use. The industrial land use category may allow employee support facilities ( such as on -site eating establishments, day -care centers, or fitness centers. Residential uses are prohibited other than one on -site caretaker or security dwelling." 2. 3. The Land Development Code describes the use of properties in the M -2 zoning district m follows, " The M -2 zoning district is established for the purpose of promoting light manufacturing processing, warehousing and wholesaling activities in a concentrated area( s) where accessibility to arterial highways is afforded and adequate levels of service are available for such industrial uses contemplated to be established in this district. The district is not intended to accommodate heavy industrial operations which would not meet the performance standards established for the district. The district regulations are intended to provide a park -like atmosphere to include aesthetic amenities including site landscaping, architectural compatibility of structures, and adequate buffering between the industrial park uses and adjacent uses of a less intense nature." 2. 4. Based on the information given to Staff, the proposed use would be classified as an Adult Congregate Living Facility" or " Rehabilitation Facility" in the Land Development Code, both of which are not permitted uses in the M -2 Zoning District. 2. 5. These uses are typically associated with the CF ( Community Facilities) Zoning District and may also be permitted as a conditional use in certain commercial or mixed use districts. 2. 6. If the property owner wishes to pursue the proposed use, revisions to both the Comprehensive Plan and Land Development Code are required. The property owner would have to submit the following applications and associated fees to begin the review and approval process: 2. 6. 1. An Application for a Future Land Use Map Amendment; 2.6. 2. An Application for Rezoning; and possibly 2.6. 3. An Application for a Comprehensive Plan Text Amendment. 2. 7. Once the applications me submitted, Staff will review the applications, provide a process calendar, complete a land use/compatibility analysis, and provide a recommendation as to whether the proposed zoning and land use would be compatible with the surrounding district. Each application will require public hearings before the Municipal Planning Board and City Council prior to approval. 2. 8. In addition, the previous property owner, Bay Sand, hic., applied for and received a building permit on February 10, 2006 for site improvements that included the construction to two buildings ( 3, 200 SF for office and storage and 1, 600 SF for a shop building), a parking lot consisting of 11 parking spaces, and landscaping. The buildings were constructed, but the parking lot and landscaping improvements were never installed; therefore, the development never received a Certificate of Occupancy. The permit was eventually invalidated for lack of activity. To date, the site improvements have not been completed to the permit specifications. Before work could resume on the property, an amendment to the building permit would be required to accommodate the new use and reinstatement. 3. FINANCIAL INFORMATION: 3. 1. There is no direct financial impact to the City. 3. 2. Typical fees will apply for the land use
