SITE PLAN APPROVAL- ALCONESE TERRACE. 107/ 109 BROOKS STREET SE Consideration of a request by applicant AI Rogerson, on behalf of owner Sawdog, LLC for site plan approval of Alconese Terrace, consisting of the construction of two buildings to include 21 residential/resort condominiums with 3, 000 SF of office space, to be built in two phases located at 107/ 109 Brooks Street SE. Building A, to be built in Phase I is located closer to the Santa Rosa Sound, is a five- story building with ten ( 10) permanent residential condominium units. Building B, to be built in Phase II and is located closer to Brooks Street, is a four-story building with approximately 3, 000 SF of office space on the first floor and eleven resort condominium units on the second to fourth floors. The City Attorney announced a quasi-judicial proceeding and swore in those who planned to testify. Ms. Fowler advised a letter was received from the applicant's attorney, John Dowd, requesting site plan approvalfor only Phase I of this project. A revised memo from Staff has been submitted that takes this request into account. Ms. Fowler explained that Phase I entails the construction of Building A along Santa Rosa Sound, and the I""'" Duggan Cottage will remain intact during this phase. She informed that Council' s packet identifies Phase I and Phase II as the items that were submitted to the CRA Board at their April 5, 2006 meeting, and that the CRA Board considered both phases as an entire project. Ms. Fowler reported the CRA recommended denialby a vote of 5- 2, with the main reason relating to the Phase II development and the status of the Duggan Cottage during that phase. Ms. Fowler clarified that if the applicant moves forward with Phase II, they would have to retum to the CRA and to Council for approval of that phase, and the project would have to meet all the requirements of the Comprehensive Plan, the LDC, and the Urban Master Plan that would be in effect at that time. 192 Regular Council Meeting 4/25/ 06 SITE PLAN- ALCON ESE TERRACE ( CONTI In the revised staff recommendation, Ms. Fowler informed that Staff supports approval of Phase I of the site plan. She discussed each condition including the changing name of the project; the applicant granting a 10- foot boardwalk easement Santa Rosa along Sound to the City; revising the site plan to show only Phase 1 demolition and construction activities; coordination with the City to revise the entrance drive to include a landscaped buffer between the drive and existing Duggan Cottage and to provide on- site parking space adjacent to the Duggan cottage; address solid waste disposal for Phase I; meeting all requirements regarding archaeological mitigation and landscape plans; and that the condo documents and all easements be reviewed by the City Attorney. Ms. Fowler further informed that based on discussion with Mr. Dowd, Staff believes everyone is in agreement with the conditions of approval and as such, the Staff report, including the letter from Mr. Dowd and the revised Staff Memorandum dated April 25, 2006, were entered into the record. Council discussion ensued as to whether or not the project should be returned to the CRA as separate requests, since their denial was based on Phase II of the project. Ms. Fowler advised that at the CRA meeting, copies of Phase I and Phase II were distributed, and the staff report discussed Phase I and II. She informed the applicant wanted it as one development but it has always been discussed and presented in the two phases. Ms. Fowler advised that In Staff's opinion, sufficient information was given for each phase and that all comments from the CRA Board relating to Phase II are contained in the record and staff report, along with drawings of both phases. Further discussion included the condition to change the name of the project to something other than Alconese Terrace. Ms. Fowler advised that for 911 and other safety issues, the name could be confusing if there was a misunderstanding in communication and emergency services were sent to Alconese Avenue rather than Brooks Street, where the project is planned. She advised the applicant has agreed to change the name of the project. John Dowd, attorney representing the applicant, advised the applicant agrees with the recommendations of Staff for approval of Phase I. However, he informed that at the CRA meeting, positive comments were directed at Phase I; it was Phase" that was the concern. Mr. Dowd commented that the developers have worked to create a project the City would be proud of, and have complied with every requirement or recommendation that the City has asked for. He stated the name change was agreed to at the CRA meeting due to the fact that so many conditions rested on approval of the project, and that in reality, they would like the name to remain Alconese Terrace. Mr. Dowd informed that pre- marketing has been done using that name, and the name was chosen because of the local historical significance. Council asked Mr. Dowd if his clients agreed with Staff's recommendations as presented in the Revised Staff Report. Mr. Dowd responded they agreed to everything except the of the name of the changing project. Dr. Pullen moved to deny the site plan for Alconese Terrace. Motion died for lack of a second. Mr. Tucker stated he favors approval of the project with the deletion of condition 1 a, which is to change the name of the project to something other than Alconese Terrace. 1
