continued the lien held by the City on this property was second in
priority to the Bank' s lien and during the foreclosure proceedings should have been removed. The
Bank has offered the City a payment of $1, 000 to offset any expenses incurred through this process.
Mr. Bolduc stressed that the release of lien applies only to this property and not other properties owned
by the property owner.
The City Attorney stated because the lien was not removed, the bank has the option to either ask the
City to voluntarily release the lien and compensate the City, or go ahead with the foreclosure whereas
the City would receive no monetary benefit. The City Attorney stated he is comfortable with the
release of lien.
The Mayor asked for public input. There was none.
Mr. Rynearson moved to release the lien and accept the payment of $1, 000 from Vanguard Bank
and Trust Company to offset any incurred costs for the property located at 205 Florida Place.
Mr. Reeves seconded motion.
Mr. Holmes stated his displeasure in the process.
The Mayor called for the vote on the motion and it carried unanimously with Holmes, gossom,
Reeves, Minich, Nabors, Rigdon, and Rynearson in favor.
MEMORANDUM OF AGREEMENT —GIBSON HOLDING POND MAINTENANCE
Mr. Beedie advised the City and County have been working for three years to develop a Memorandum
of Agreement to fund a capital project to install an overflow structure from the Gibson Holding Pond
to the creek running through the Golf Club property to alleviate flooding problems, particularly along
Mar Walt Drive.
Mr. Beedie continued the overall estimated cost to complete the project is $ 44, 440 and based on the
75/ 25 cost allocation for the project, the County would be responsible for $ 33, 330.00 and the City
responsible for $ 11, 100. 00.
The Mayor asked for public input. There was none.
Mr. Reeves moved to authorize the Mayor to execute a Memorandum of Agreement with
Okaloosa County to construct stormwater system improvements at the Gibson Holding Pond on
the City' s Golf Club property to alleviate flooding issues along Mar Walt Drive, and to approve
to utilize Stormwater Utility Enterprise Net Assets funding in a not -to- exceed amount of
15, 000. 00. Mr. Rigdon seconded motion and it carried unanimously with Holmes, gossom,
Reeves, Minich, Nabors, Rigdon, and Rynearson in favor.

LEGISLATIVE MEETING (CONT)
Mr. Rynearson questioned if it would be possible to revisit with the legislature how traffic fines are
distributed among the state, county and cities since cities receive the least amount when they are the
entity issuing the ticket. The City Manager agreed the formula seems unfair and should be brought up
before the legislature, and that he would come back with background information on how the formula
is determined.
CITY MANAGER REPORTS
The City Manager recognized Kay Rasmussen of the EDC and noted the City, EDC, and Chamber
meet once a month to discuss ideas on economic development and business retention.
The City Manager also discussed the meeting he had with residents of Country Club Avenue and that
he suggested a professional traffic study be conducted of the area before any action is taken to close
the road, and that he will bring back a scope of services at the January 11 meeting.
The City Manager also informed the Employee Survey is being looked at and the results will not be
known until mid -December, and that meetings are being planned with the employees to discuss the
performance measures.
