BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: March 18, 2014 TO: Honorable Chairman and Members of the Board FROM: Kay Godwin SUBJECT: Workers Compensation Claim Settlement DEPARTMENT: Human Resources BCC DISTRICT: All STATEMENT OF ISSUE: Request approval of a Workers’ Compensation claim settlement for Steven St.Clergy. BACKGROUND: On August 20, 1998, Steven St.Clergy, a former employee of Okaloosa County, suffered a work related injury. Mr. St.Clergy has received extensive medical treatments over the years. The expenses incurred on this claim have exceeded the county’s worker’s compensation retention. The excess worker’s compensation insurance carrier has negotiated a settlement of this claim. This settlement will not require the county to make any contribution to the settlement amount. The agreed upon settlement amount is $331,000.00. OPTIONS: The Commission can agree to approve the settlement or provide further direction. RECOMMENDATIONS: As Okaloosa County has reached its limit of liability and the excess insurer is solely responsible for this claim, Okaloosa County has a duty to not unreasonably refuse to consent to a settlement. Failure to consent to this settlement could expose the county to liability for unreasonably withholding its consent to the settlement. Risk Management recommends approval of the settlement RECOMMENDED BY: APPROVED BY: Ernie Padgett, County Administrator
