BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: January 8, 2013 TO: Honorable Chairman and Members of the Board FROM: Elliot Kampert SUBJECT: Public Hearing - Plan Amendment/Rezoning - JRW Investments DEPARTMENT: Growth Management BCC DISTRICT: Three ISSUE: 361573-BCC-2012 and 361577-BCC-2012. Consideration of a request changing the use of land submitted by James R. Watts as agent for JRW Investments, LLC relating to property located at 4367 Log Lake Road, Holt. The request is to change the Comprehensive Plan Future Land Use Map (FLUM) designation for the property from Industrial (I) to Commercial (C), or a more restrictive FLUM designation. If the FLUM amendment is approved, request to rezone the property from Industrial (I-1) district to General Commercial (C-3) district, or a more restrictive zoning district. Property contains 9.42 acres, more or less. STAFF FINDINGS: • The property is the site of a vacant convenience store. • The property was previously used for commercial purposes. • The current Industrial FLUM designation and zoning does not allow the property to be used for a convenience store or similar commercial purpose. • The property is classified as commercial (‘supermarket”) by the Property Appraiser for property tax purposes. • The requested changes would allow the existing building to be used as a convenience store or other similar commercial purposes. • There are other commercial-designated and zoned areas in the immediate vicinity. PUBLIC COMMENT/OPPOSITION: None to date. STAFF POSITION: Staff has no objection to the requested FLUM amendment and rezoning. PLANNING COMMISSION: The Planning Commission voted unanimously to recommend approval at a public hearing held December 13, 2012. MILITARY REPRESENTATIVE: No comment. RECOMMENDATION: It is recommended that the Board consider the facts presented herein, the Planning Commission recommendation, as well as any other facts that may be presented at the public hearing, and then decide whether or not to adopt the requested FLUM amendment and rezoning by ordinance. RECOMMENDED BY: APPROVED BY: James D. Curry, County Administrator
