BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: August 4, 2015 TO: Honorable Chairman and Members of the Board FROM: Jason Autrey SUBJECT: Tanglewood/Overbrook Stormwater Improvements - Final Change Order DEPARTMENT: Public Works BCC DISTRICT: 4 STATEMENT OF ISSUE: Public Works is requesting Board approval of a final Change Order for the Overbrook/Tanglewood Stormwater Improvements Project. This Change Order will re- price the original contract amount due to a substantial underun in the plan quantity for excavation volume (cubic yards), and will add additional improvements to the original scope of work in order to maximize the use of available grant funding for the project ($414,432.00). There is no match required for construction funding of this project. BACKGROUND: As a result of a settlement related to the Deep Water Horizon Oil Spill, FDEP allocated funds to Okaloosa County to assist with stormwater improvements in the Gap Creek Watershed Area. The two projects identified were the Tanglewood Stormwater Basin and the Overbrook retention area in Fort Walton Beach. Design plans and estimated quantities for both projects were produced by the Northwest Florida Water Management District Office in Havana, FL. During construction of the improvements, it was discovered that the original volume of excavation for both ponds was vastly miscalculated. Public Works staff was tasked with not only inspecting the projects on a daily basis but also tallying actual truck counts during the excavation and hauling operations. The contract value associated with the underrun of excavated material totaled to $177,952.50. A meeting with Public Works staff, the Contractor, FDEP and the NWFWMD to discuss the issue resulted in all parties agreeing to adjust the unit price for excavation from $7.50/CY to $12.00/CY per provisions in the Standard General Conditions (EJCDC) of the contract. At this time, the subject Change Order reflects the re-priced contract with the addition of the new scope of work at the Tanglewood Pond location to include the following main items of work: • Replacement of a new concrete spillway located between the Tanglewood ponds. • Clearing, realigning and lining with rip-rap rubble the three ditch channel feeding the ponds. • Replacing a sidedrain for the north access drive to the property. • Clearing, fine grading and sodding the rest of pond 2 (outfall) to include the pond bottom and the side slopes. Throughout the process of re-pricing the contract, staff has received input from County legal. All parties involved, including FDEP and the NWFWMD, have reviewed and given approval of the plans for the additional improvements (completed in-house) and the attached Change Order. OPTIONS: Approve/Disapprove the Change Order for additional improvements at Tanglewood Pond. RECOMMENDATIONS: Approve the Change Order for additional improvements at Tanglewood Pond. RECOMMENDED BY: APPROVED BY: John Hofstad, County Administrator
