BOARD OF COUNTY COMMISSIONERS
AGENDA REQUEST
DATE: January 22, 2013
TO: Honorable Chairman and Members of the Board
FROM: John Hofstad
SUBJECT: Biomass Estimation Project RFP
DEPARTMENT: Public Works
BCC DISTRICT: All
STATEMENT OF ISSUE: Staff requests the approval of the Board to request proposals from
commercial interests for a Biomass Estimation Project.
BACKGROUND: A grant application was prepared and subsequently awarded for the Okaloosa
County Biomass Estimation Project through a grant from the Gulf Tourism and Seafood
Promotion Fund (GTSPF). The $450k award was accepted by the County in early December
2012. Since that time, staff has been preparing a Request for Proposal to solicit proposals from
the private sector. In the spirit of the general BP restitution effort, award of the contract will
favor local business.
An official selection committee has been identified to review bids. It is also recommended that a
Commissioner be nominated to participate on the selection committee. The members of the
selection committee are as follows:
Scott Henson
Jason Autrey
Clay Simmons
James Puckett
Commissioner - To Be Determined
Jack Allen from the Okaloosa county Purchasing will be providing guidance to the selection
committee.
OPTIONS: Approve/Disapprove
RECOMMENDATIONS: Staff recommends that the Board approve solicitation for proposals
from prospective bidders for the recently awarded Biomass Estimation Project and subsequent
approval for the selection committee as specified.

BOARD OF COUNTY COMMISSIONERS
AGENDA REQUEST
DATE: January 22, 2013
TO: Honorable Chairman and Members of the Board
FROM: John Hofstad
SUBJECT: Remediation Settlement Agreement Approval
DEPARTMENT: Public Works
BCC DISTRICT: 4
STATEMENT OF ISSUE: Approval of the attached settlement agreement between Okaloosa
County and Dr. Paul Hsu & his wife Majes Hsu.
BACKGROUND: The Okaloosa County South Yard facility at 84 Ready Avenue, Fort Walton
Beach provides administrative offices for Public Works and operational facilities for other
department; Road, Traffic, Fleet and Mosquito Control. Activities regularly occurring at the
facility include vehicle storage and maintenance, bulk material storage, painting, steam cleaning,
hazardous waste storage, oil storage, propane gas storage, and construction material shortage.
Also housed on site is a fueling facility that serves vehicles from all County operations.
Fueling operations in the late 1990’s included three documented fuel releases of 140 to 2,000
gallons into the environment. Assessment of the environmental impact of the fuel releases began
in 2000 and concluded in 2005. A network of over 50 monitoring wells was installed to collect
chemical impact data. The results of the assessments revealed that the fuel releases caused
impacts to the soil and groundwater on the County site but had also migrated in the groundwater
south beyond the County property line onto three adjacent parcels owned by Dr. Paul Hsu & his
wife Majes Hsu. The affected parcels contain several buildings that over the years have been
occupied by businesses owned by or leased to by Dr. Hsu.
Remediation of the contamination was implemented in a phased approach beginning with the
source area on the County yard in 2006. Phase II remediation was initiated concurrent with
Phase I activities to address chemical impacts on offsite property. The type of remediation
selected for the cleanup was Air Sparging (injection of air into the groundwater) and Soil Vapor
Extraction (removal of contaminated air from the unsaturated soil). Operation of the full
remediation system on offsite properties reportedly produced odors in one of the buildings on the
Hsu property and caused some non-structural impacts to the building infrastructure. Portions of
the remediation system that may have caused these impacts were shut down.
In the spring of 2012, the Florida Department of Environmental Protection (FDEP) presented a
list of seven remediation options to Dr. Hsu which had been identified as potential strategies to
address chemical impacts on his property. In response to the recommendations provided by
FDEP Dr. Hsu met with County staff to discuss the proposed remediation strategies. Through a
