STATEMENT OF ISSUE: The Grant of Easement will replace the expired land lease for
Niceville Landfill. The County continues to address environmental issues at the landfill that are
attributed to long term land-filling activities.
BACKGROUND: The County has leased the subject property from Eglin Air Force Base for
decades. The lease expired in 2012. The County initiated lease renewal procedures well before
the expiration date. However, during evaluation of the lease renewal, Eglin Air Force Base
Environmental Flight suggested that the site footprint should be extended to a perimeter that
included all environmental restoration infrastructure. The County re-surveyed the new site
perimeter and re-submitted the results. Based on the new site perimeter, the Eglin Air Force
Base Real Estate office prepared a new Grant of Easement to replace the Land Lease Agreement.
This Grant of Easement term is 25 years, beginning on 22 May 2012 through 21 May 2037. The
cost of the easement is $1 plus recording fees. The County must record the easement in Public
Records and provide Eglin Air Force Base with the Official Record Book and Pages within 24
days after the executed easement is received back from the Eglin Air Force Base Real Estate
Office.
The Grant of Easement requires the signature of the Board Chairman.
OPTIONS: Approve/Disapprove
RECOMMENDATIONS: Staff recommends Board approval of the Grant of Easement and
further requests authorization for the Chairman to sign all associated documentation.
