1st 2nd ORDINANCE 1898 AN ORDINANCE OF THE CITY OF FORT WALTON BEACH, FLORIDA; PROVIDING FOR AUTHORITY; AMENDING VOLUME IV, LAND DEVELOPMENT CODE, CHAPTER 12.42 COMMERCIAL DISTRICT, C-2, SECTION 12.423.02 HEIGHT OF BUILDINGS; PROVIDING FOR REPEAL OF PRIOR PROVISIONS; PROVIDING FOR SEVERABILITY, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCil OF THE CITY OF FORT WALTON BEACH, FLORIDA, AS FOLLOWS: SECTION I. AUTHORITY. The authority for enactment of this ordinance is pursuant to the powers for the City of Fort Walton Beach, provided in Section 2 of the City Charter, and Section 166. 021 ( 1), Florida Statutes. SECTION II. Volume IV, Land Development Code. Chapter 12.42, Commercial District, Section 12.423, C- 2, is hereby amended as follows: Section 12.423.02 Maximum Height of Buildings No building or structure in a C 2 general commercial district shall exoood 150 or 15 stories in height. The maximum haicht of all buildincs shall be 70 feet. SECTION III. REPEAL OF PRIOR PROVISIONS. In the event any Ordinance or parts of Ordinances are in conflict herewith, the provisions of this Ordinance herein shall prevail. SECTION IV. SEVERABILITY. Should any section or provision of this ordinance, or any portion thereof, be declared by a court of competent jurisdiction to be invalid, such decision shan not affect the validity of the remainder, as a whole or any part hereof, other than that part declared to be invalid. SECTION V. EFFECTIVE DATE. This ordinance shall take effect immediately upon approval by the City Council and signature of the Mayor.
