Re: Sound Side Apartments LL
Dear Mr. Mesons:
rMN
The Fort Walton Beach Housing Authority ( FWBHA) is re- developing the former
Germany Terrace public housing site as 200 affordable units. In order to keep rents affordable,
FWBHA would like to allocate 50 of its Housing Choice Vouchers to this development.
HUD permits the attachment of the assistance to this project, but it must be accomplished
through a competitive application process. The regulations are found in Part 24 ofthe Code of
Federal Regulations, Section 983. Per these regulations, the award must be made in an arm' s
length manner.
Since FWBHA will be awarding these vouchers to a project in which it has a financial
interest, HUD requires that an independent entity review the award process to ensure the award is
arm' s length. The independent entity is typically the local government where the housing authority
hasjurisdiction. In fact, the applicable regulation, 24 CFR Part 983. 59 states, " The independent
entity that performs these program services may be the unit of general local government for the
PHA jurisdiction."
The independent entity review requires three key steps:
1. Review the application to ensure it is consistent with FWBHA and has been approved in an
ann' s length manner. FWBHA has also retained the services of a consultant to review the

application and opine on the same, but the consultant cannot be considered independent.
We will make this review available to you.
2. Review the proposed rents to confirm they do not exceed the rents of other comparable
units. FWBHA is also required to have the rents determined by a state certified appraiser.
The appraisal has been completed and a copy will be provided to you.
3. Once construction is complete, inspect the units to make sure they meet HUD' s Housing
Quality Standards. The City is already required to inspect the units for the purpose of
issuing the Certificate of Occupancy. This inspection will meet HUD' s requirements. In
addition a HUD designated independent inspector will inspect the units prior to HUD
issuing its Permission to Occupy the units. r
o
The City would be responsible to state in writing that its review has determined that the award E
was made in an arm' s length manner and the rents are reasonable. This letter will he retained in the am
FWBHA files.
x0
Steps I and 2 most be performed as soon as possible. Without this approval, construction 3
cannot proceed.
MN
We look forward to meeting with you on November 8, 2011 to answer any questions or
concerns you may have.
Sincerely,Sincerely,
FortFort WaltonWalton BeachBeach HousingHousing AuthorityAuthority
