BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST DATE: May 19, 2015 TO: Honorable Chairman and Members of the Board FROM: Jason Autrey SUBJECT: Silver Beach Vacation Request, First St. 20' Wide Alleyway DEPARTMENT: Public Works BCC DISTRICT: 5 STATEMENT OF ISSUE: Mr. Charles W. Clary III, FAIA, on behalf of the owners (including himself) of the Tropical Wave Souvenir Shop in Destin, Florida, would like to request a Public Hearing be scheduled on June 16, 2015 to consider the vacation of a portion of First Street containing a 20' wide alleyway in the Silver Beach subdivision. BACKGROUND: Mr. Charles W. Clary III is the property and business owner of the Tropical Wave Souvenir Shop. Mr. Clary, along with adjacent property owners of The Track, is requesting a public hearing for the vacation of that portion of First Street containing a 20' wide alleyway lying to the west and within Block 16 of Silver Beach in Destin, Florida. Dating back to the late 70's and 80's, most of the platted right-of-way within the Silver Beach subdivision has been vacated except that particular portion of First Street containing an east-west alleyway of approximately 20' in width. At this time, Mr. Clary along with the aforementioned property owners desire to formally request a vacation of the subject alleyway. Mr. Clary indicated that the original survey when acquiring the property showed this portion of First Street and the alleyway through Block 16 as previously vacated. During a title search at the request of Mr. Clary, it was discovered that the right-of-way and 20' alley in question were never formally vacated. Attached photos reveal existing improvements within the area to be vacated. Staff recommends approval of the request and holds that the vacation will not adversely affect any of the adjacent landowners other than to provide clear title to the parcels as they now exist. OPTIONS: Approve/Disapprove the Public Hearing request to vacate a portion of First Street containing the 20 foot alley along Silver Beach. RECOMMENDATIONS: Approve the request to convene a Public Hearing during the regularly scheduled Board of County Commissioners Meeting on June 16, 2015 at or shortly thereafter 9:00am to vacate a portion of First Street containing the 20 foot alley along Silver Beach. RECOMMENDED BY: APPROVED BY: John Hofstad, County Administrator
