BOARD OF COUNTY COMMISSIONERS
AGENDA REQUEST
DATE: December 18, 2012
TO: Honorable Chairman and Members of the Board
FROM: Commissioner Dave Parisot
SUBJECT: Update Concerning the RESTORE Act Funding Formula
At the 8-county meeting in Walton County on Dec. 7, the counties unanimously voted to revise
the formula for subject. The counties which will take a slight decrease are Escambia, Okaloosa,
Bay and Walton. The counties which will receive an increase are Santa Rosa, Gulf, Franklin,
and Wakulla. The attachments show the "old" or Nelson Amendment formula which was
removed from the Act by Congressman Southerland during House/Senate conference and the
new formula voted by the Gulf Consortium Directors from the applicable counties on Dec. 7.
What we actually voted on and approved was the percentages to be allocated to each County for
"Pot 1" funds, i.e.,(from West to East) Escambia @ 25.33%; Santa Rosa @ 10.50%; Okaloosa
@ 15.23%; Walton @ 13.71%; Bay@ 15.10%; Gulf @ 6.74%; Franklin @ 8.44%; and, Wakulla
@ 4.94%.
Attachment 1 is a comparison of the "old" 8-counties formula with the "new" formula voted on
at the Gulf Consortium 8-County meeting on Dec. 7 at Walton County.
Attachment 2 shows the application of the formula factors for each of the 8 counties with varying
amounts of the BP civil fine as examples (fine not set yet). The distribution percentages in the
column labeled "20% + 80%" shows the percentages adopted by the 8-County Consortium sub-
group.
Attachment 3 shows the factors used to compute the percentages for each county in Attachment
2. We opted to adopt the percentages shown rather than the paragraph on the explanation to
eliminate any differing interpretation by the U.S. Treasury Department. By adopting the
percentages, it will be clear and simple for Treasury to merely multiple the 8-County "Pot 1" fine
amount to do the allocation for each county.
The proposed Resolution prepared by Sarah Bleakley of Nabors, Giblin & Nickerson is attached,
as well as an update from the Florida Association of Counties.
