The plans included the extension of a sidewalk along the north side of Brooks Street to tie in to an existing sidewalk on U. S. Highway 98. Upon completion of construction, it was discovered that a portion of the sidewalk encroached onto the adjacent private property. Discussion: An easement was granted on January 11, 2008 to the City of Fort Walton Beach by George Elliott Mitchell, owner of the property. The easement is triangular in shape and measures approximately 130 square feet. The easement was reviewed and approved by the City Attorney as to form and legal sufficiency. Recommendation: Respectfully request that the City Council accept the Grant of Easement from George Elliott Mitchell for a portion of the sidewalk on the north side of Brooks Street adjacent to the overflow parking lot that serves the Sailwatch Landing Condominiums.
