required to pay or reimburse for all costs associated with the wire intercept, especially regarding charges from phone companies. Phone company charges are normal, and we would be obligated to pay those charges, whether or not we entered into the agreement with the San Bernardino County Sheriff' s Department. 1. 8 The OLU also provides for asset sharing on seizures related to wire taps or pen registers supported through this agreement. It is customary to share assets among agencies participating in such agreements. Based upon our history, we would be more likely to gain through such asset sharing, rather than suffer a reduction. 1. 9 The Fort Walton Beach Police Department would benefit immensely whenever wire intercept /pen connections are authorized because the manual monitoring of such devices, which can be extremely expensive, would no longer be required. 21 2. DISCUSSION: 2. 1 Since this Operational Letter of Understanding ( OLU) actually governs operations between the two agencies, it would, therefore, normally not require Council approval. However, Council approval is sought inasmuch as reimbursement expenses are listed therein, albeit no expenses are anticipated, except those which are passed through. 3. FINANCIAL: 3. 1 The Fort Walton Beach Police Department will benefit by being permitted the use of the San Bernardino County Sheriff Department' s IRNET and PENS networks for any and all wire intercept /pen connections that we may be authorized to conduct from time to time. 3. 2 No expenses, other than those reimbursable to phone companies would be incurred. Those expenses would accrue, regardless of the OLU, although the expenses would otherwise be paid directly to the phone companies. 3. 3 No budget transfer will be required. Such investigative costs, when they arise, are included within the FWBPD investigative budget. 4. CONCLUSION: 4. 1 It is in the best interest of the City of Fort Walton Beach and its citizens for the Police Department to conduct covert operations in the investigation of certain crimes. 4. 2 Such investigations are well regulated by law and sometime include electronic intercept and monitoring, which are closely reviewed by the courts. 4. 3 It would be both a physical and a fiscal benefit to the FWBPD to make use of the SBCSD' s automated systems and capabilities for this purpose. 5. RECOMMENDATION: 5. 1 It is recommended that Council approve the proposed Operational Letter of Understanding, between the San Bernardino County Sheriff's Department and the Fort Walton Beach Police Department, and authorize the Police Chief to execute the agreement.
