The son and the caregiver of the property owner provided a letter requesting the City settle the fees and fines for a total of $ 1, 650. 00, and Mr. Bolduc informed that Mr. Lorenz recommends acceptance of the offer, citing reasons of homestead exemption and owner competence. Oftl, Discussion included that the property is in compliance at this time; however, equipment remains on the property that could result in another code enforcement case, but that has not transpired at this time. The Mayor asked for public input. There was none. Mr. Nabors moved to reject the offer of $ 1, 650.00 and to table discussion until sometime in the future. Mr. Rynearson moved a friendly amendment to an open -ended date no later than 60 days, or the Council meeting of June 22, 2010. Mr. Nabors stated he would not accept the friendly amendment. The City Manager advised he would update and provide additional information to Council at their June 22 meeting. The City Attorney advised a motion is still needed whether to accept or reject the offer. The City Manager questioned why a motion was needed since the item is being continued to June 22, when he provides additional information and Council will be in a better position to accept, reject, or amend the offer. Mearns, City Manager FROM: Ted Litschauer Chief of Police DATE : May 21, 2010 REF : Memorandum of Understanding with NFLICAC 1. BACKGROUND: 1. 1 The Fort Walton Beach Police Department ( FWBPD), as well as the City of Gainesville and various other federal, state and local law enforcement agencies, have individually entered into an annual Memorandum of Understanding ( MOU) with the North Florida Internet Crimes Against Children Task Force ( NFLICAC). The North Florida Internet Crimes Against Children Task Force provides the MOU for signature by the chief law enforcement officer of the jurisdiction, which in our case is the Chief of Police. 1. 2 The City Council has previously authorized the Fort Walton Beach Police Department to execute a Memorandum of Understanding for this purpose. 1. 2. 1. 1 The MOU with NFLICAC has previously required annual renewal. 1. 3 Effective May 31, 2010,NFLICAC MOUs will no longer expire annually. This MOU will continue perpetually, unless canceled by either party. The MOU provides that either party may cancel the MOU with appropriate notice. 1. 4 The purpose of this MOU is to formalize working relationships between participating agencies, in order to achieve maximum cooperation in a combined law enforcement effort aimed at combating and technology crimes against children in the state of Florida and nation wide. 1. 5 The parties agree that the task force is a joint operation in which all agencies act as partners. The Gainesville Police Department, Investigations Bureau' s chain of command, is responsible for the policy and general direction of the task force. The task force coordinator will periodically contact supervisors and investigators from other participating agencies to keep them informed of training opportunities, unusual circumstances, as well as problems or successes of the task force. 2. DISCUSSION: 2. 1 A review of similar and previous MOU documents by the Fort Walton Beach city attorney has determined it contains provisions which require approval and authorization for the Police Chief to sign it. 13 3. FINANCIAL: 3. 1 The only expenses to be incurred, relative to participation in this task force, will be ordinary payroll costs for the duty time expended. 3. 2 No budget transfer is required 4. CONCLUSION: 4. 1 It is in the best interest of the City of Fort Walton Beach and its citizens for the Police Department to work well with other law enforcement agencies, including the North Florida Internet Crimes Against Children Task Force. 4. 2 It is prudent to have a current Memorandum of Understanding ( MOU) to guide the actions of the various agencies as they work together. 5. RECOMMENDATION: 5. 1 I recommend that the City Council approve this Memorandum of Understanding with the North Florida Internet Crimes Against Children Task Force and authorize the Police Chief to execute it. III. INTENT AND PURPOSE OF AGREEMENT The purpose of this MOU is to formalize working relationships between agencies that have entered into written agreement to achieve maximum cooperation in a combined law enforcement effort aimed at combating technology facilitated crimes against children in the State of Florida and nationwide. By signing this MOU, participants are agreeing to join the North Florida Internet Crimes Against Children Task Force ( hereinafter ICAC) for the purpose of promoting a coordinated effort in investigating and prosecuting said crimes and adhere to the ICAC Operational and Investigative Standards. This MOU is not intended, and should not be construed, to create any right or benefit, substantive or procedural, enforceable by law or otherwise by any third party against the parties, the United States, or the officers, employees, agents, or other associated personnel thereof. 2010 North Florida ICAC Task Force MOU Page 1 of 4 Printed: 5/ 17/ 2010 15 IV.
