In addition, 288 natural constraints such as the shape and natural features of a site may present obstacles to 289 achieving maximum density and/ or intensity shown on the adopted Comprehensive Plan FLUM. 290 291 Policy: Environmentally Sensitive Lands. All developments requesting to construct on 292 environmentally sensitive lands including wetlands, transitional wetlands, tidal waters, 293 designated listed species critical habitat, and the natural shoreline must provide proof of 294 development approval from all required state and federal agencies. 295 296 Policy: Open Space. With the exception of historic downtown the minimum required open space 297 within all FLUM designations will be 25 percent. Notwithstanding, Prime Development within 298 the certain planning areas specified in the LDC may be eligible for a reduction in opens ace 299 below the required minimum 25 percent. The " open space incentive program" will be designed 300 so that no development will be approved with less than 12 percent open space The " open space 301 incentive program"will, at a minimum, include a provision that developments located in the 302 CBD be allowed to deduct the total area dedicated to pedestrian and/ or vehicular easements or 303 rights- of-way wo the public from the required minimum 25 percent open space. 304 305 Policy: Method of Measuring Building Height. The measurement of building height will be 306 determined as established by the LDC and does not include non -habitable architectural roof 307 embellishments ( e. g. spires, watch towers, crows' nests, cupolas, chimneys, and similar 308 architectural embellishments), dormers, or appurtenant structural systems ( e. g. machinery rooms, 309 elevator shafts, stairwells, and similar ancillary facilities). Habitable space that is located within 310 sloping roofs, when such roofs are a requirement of the LDC, will not count in the measurement 311 of height of the building or number of floors. 312 313 Policy: Intensity Defined. Floor Area Ratio ( FAR), will be used to determine the maximum 314 square footage allowed for non -residential uses on a development site. Non -residential uses FWB 2010 -2020 Comprehensive Plan I The Future Land Use Element EAR Based Amendment I STRIKE -THRU VERSION 125 315 include hotels, motels, bed and breakfast establishments and other duly licensed commercial 316 transient accommodations as defined in Section 509 242( 1), ( a), ( b), ( f), and ( h) Florida Statutes 317 but do not include permanent and long -term or seasonal and short- term residential uses The 318 specific FLUM designations will identify the maximum FAR for non -residential uses 319 320 Policy: FAR will not be applied to publicly -owned parking _garages or to areas of parking 321 garages dedicated to the public when of a public- private development part partnership. 322 Additionally, development projects within special planning areas CBD, CT, MUTC, MUUP 323 MUVB, MUMT, MUEB, MUW, MUHD are allowed a 0.50 FAR bonus for above- around 324 325 parking structures. The 0. 50 FAR bonus will be applied only to above -grade structured parking being separate and in addition to the FAR maximums stated in development categories " Grade," 326 " Staple" and " Prime" that apply to non -residential (and not structured parking) 327 328 Policy: Density Defined. Density will be used to determine the maximum number of residential 329 units allowed on a development site. Residential uses include permanent or long -term and 330 seasonal or short -term residences. Hotels motels bed and breakfast establishments and other 331 duly licensed commercial transient accommodations as defined in Section 509. 242 ( 1), ( a), ( b), 332 ( fl, and ( bi Florida Statutes are not regulated by density. The specific FLUM designations will 333 identify the maximum density for residential uses 334 335 Policy: Height, Intensity, and Density Bonus Provisions Various height, intensity, and density 336 bonus provisions are provided in the MUCC, MUW, MUV -NW, MUHD, CBD, CT, MUTC, 337 MUM MUUP, MUVB, MUCR, MUEB and MUMT land use designations; but not all bonus 338 provisions are included in all designations. The LDC will establish specific bonus provisions 339 These provisions will be initiated to stimulate reinvestment in high standards of design through 340 implementation of a performance -based bonus system that grants incentives for actions that are 341 consistent with design criteria that cannot otherwise be mandated The outcome will result in 342 high quality, innovative development that enhances site and building design, achieves land use 343 compatibility, promotes non -motorized mobilily, and provides the opportunities for achieving 344 extraordinary public benefit. Height, intensity, and density_provisions are provided in three 345 categories of development. 346 347 Policy: Levels of performance standards are categorized as Grade, Staple and Prime: 348 349 Standard Grade Development: Provides a maximum " by-right" building height and density 350 specified by the land use designation which can be achieved by adherence to the standard site 351 development criteria specified in the LDC such as, but are not limited to, setbacks, o en s ace, 352 parking, access and circulation, landscaping and minimum required buffers including those to 353 help assure smooth transition between distinctly different land uses 354 355 Staple Development: Allows for attainment of additional building density ( dwelling units per 356 gross acre) beyond Standard Grade Projects upon compliance with supplemental design 357 standards pertaining to such items as building mass; building facade and elevations, fenestration; 358 varied roof line; open space, setbacks and landscaping; pedestrian amenities, and design 359 initiatives that accommodate transit needs. FWB 2010 -2020 Comprehensive Plan ( The Future Land Use Element EAR Based Amendment I STRIKE -THRU VERSION 126 360 361 Prime Development: Allows the highest building height and density thresholds based on a 362 special emphasis on attaining a heightened level of amenities beyond Staple Development levels 363 The additional height and density will be achievable if the development meets all requirements 364 of a Prime Development with special emphasis on providing a specified " public benefit." 365 366 1. Waterfront Access Improvements. For improved access to the shoreline, this policy 367 will be carried forth within the MUW, MUTC, MUHD, and MUEB designated areas 368 through private investment in the form of dedicating_ pedestrian easements to the 369 public for access from public areas to the waterfront (public access points), and/ or the 370 design, permitting, and construction of pier facilities that include boater amenities 371 372 2. Site plans must demonstrate 394 architecturally designed open space malls and arcades equipped with pedestrian - 395 oriented furniture and streetscape. 396 397 7. Create and/ or Reinforce a Pedestrian Friendly Transit System. Encourage private 398 investment in creating and /or reinforcing a pedestrian friendly transit system. Such 399 programs must demonstrate a transit friendly environment consistent with an adopted 400 public plan for public transit. The plan will include transit stops with dedicated area 401 for safe and convenient off street - transit access and passenger shelters equipped with 402 appropriate furnishings, architecturally design lighting and streetscape. 403 404 8.
