given. Brian Rosales, 412 Holmes Blvd., questioned the electricity and funding and noted the CRA's lack of support due to the lack of a commitment from the Friends as to when the vessel would actually be docked at the Landing. Doug Reed, 842 Santa Rosa Court, speaking as a downtown merchant and not as a member of the CRA, stated his feeling that this endeavor needs to be moved forward and noted the benefit it would provide to the City as well as the historical value, and urged Council to support the request. 10- wim Regular Council 2/ 23/ 10 GOVERNOR STONE ( CONT) The City Manager verified the cost for the signage and power `would be' in the vicinity of 800. 00, and funds would come from the CRA account and not the general fund As there was no one else who wished to speak, the public input was closed. Mr. Garvie moved to approve funding at a cost not to exceed $ 11000 for the electrical outlet and instructional signage for the Governor Stone. Mr. Patterson seconded motion. Discussion ensued regarding the need for a contract-with the Friends of the Governor Stone to address the logistics as well as liability issues. The City Attorney suggested an amendment to the motion that states funding be consistent with the City Code and state and federal laws as well as any liability issues regarding insurance for the City. Mr. Garvie noted his understanding that the vessel will be viewed by the public from the dock and not from the ship; therefore, there should not be a liability issue. Mr. Garvie amended the motion to include that funding is pursuant to the City code and state and federal laws, as well as insurance liability issues regarding insurance for the City. Mr. Patterson accepted the amendment. The Mayor called for the vote on the motion as amended and it carried by a vote of 4 to 3 with Reeves, Anderson, Garvie, and Patterson in favor and Holmes, Nabors, and Rynearson opposed ( Seat 2 Vacant). NO COST CITY CEMETERY GRAVES FOR PERSONS KILLED IN LINE OF DUTY Discussion of No Cost City Cemetery Graves for Persons Killed in the Line of Duty. Mr. Patterson discussed his desire that the City adopt a resolution to provide, at no cost to families, cemetery graves to persons killed in the line of duty, which would include City police officers, firefighters, and active duty military , who reside in the corporate City limits. Mr. Patterson feels this would be a good way for the City to express appreciation to those who put their lives in jeopardy for the City and the country. Discussion included the vagueness of the term " line of duty" and whether it should be considered on a case by case basis. Mr. Patterson stressed his desire that the term encompass Fort Walton Beach police officers and firefighters who die performing their jobs, and any member of the United States military who is a resident of Fort Walton Beach. The Mayor opened the floor for public input. As there was none, the public input was closed. Mr. Patterson moved to authorize the City Attorney and City Manager to develop a resolution to provide for no -cost cemetery graves to those killed in the line of duty, and to define line of duty as Fort Walton Beach police officers, firefighters, and any member of the United States military who is a resident of Fort Walton ' Beach. Mr. Garvie seconded motion and it carried by a vote of 4 to 2 with Holmes, Garvie, Patterson, and Nabors in favor and Reeves and Rynearson opposed (Seat 2 Vacant). ESTABLISHMENT OF CITIZEN' S BUDGET COMMITTEE Discussion of the Establishment of Citizen' s Budget Committee. Mr. Patterson discussed creating a Citizen' s Budget Committee to advise Council on budgetary decisions. Mr. Patterson feels this would give the citizenry an opportunity to study the budget and provide input on issues and to gain a better understanding of the budgeting process. 100 Regular Council 2/ 23/ 10 CITIZENS BUDGET COMMITTEE ( CONT) Mr. Patterson moved to authorize the City Manager to set up a Citizen' s Budget Committee of eight citizens of the City to examine the 2009 budget and come back to the City Council with suggestions and improvements. Mr. Garvie seconded motion. Council discussion included the undue pressure this would cause the City staff; that the budget is available to the public at any time; that meetings are held and the public has every opportunity to attend, as well as contact Council with questions; that only a few of the same citizens attend budget meetings or show an interest in the process; that it would be difficult to find eight persons to volunteer; and that it would not be a practical use of City staff. The Mayor opened the floor for public input. Brian Rosales, 412 Holmes Blvd., stated he agreed with Mr. Patterson' s sentiment and that there is an opportunity for input; however, Mr. Rosales stated he also agreed with the other comments and suggested advertising for more citizen participation rather than assuming that just because a budget is available that people will take look at it. As there was no one else who wished to speak, the public input was closed. The Mayor called for the vote on the motion and it failed by a vote of 2 to 4 with Garvie and Patterson in favor and Holmes, Reeves, Nabors, and Rynearson opposed. CITY MANAGER ANNOUNCEMENTS The City Manager advised of a funding opportunity through the Florida Legislature which would provide for the installation of a force main. The City Manager stated if there were no objections from Council, Staff will move forward with the application. There were no objections from Council. The City Manager expressed his sympathies to the family of Virgil Miller, and stated Mr. Miller was very kind to him when he applied for the position of City Manager and that his kindness was appreciated. CITY ATTORNEY ANNOUNCEMENTS The City Attorney discussed the succession of Seat 2, and advised that the Charter requires that at least two meetings be held after the creation of a vacancy to accept nominations for the position. The City Attorney suggested that Council may want to have three meetings to accept nominations since this meeting is so soon after the vacancy occurred, so there are a total of two full meeting to accept nominations. She continued that once nominations are accepted, the Seat 2 successor will be appointed in that third or fourth meeting, and the individual must be someone who was nominated during the public meetings. The City Attorney noted there may be another vacancy on Council in the near future, but that will be addressed when and if it occurs. The Mayor received clarification that Council is not limited to the amount of nominations made, and that a majority of the vote is required to appoint the successor. Discussion included that the Public Information Officer prepare a press release seeking nominations for the vacancy, and that the press release include that any requests for appointment or letters of intent be sent to the City Clerk. Consensus of Council was to accept nominations for Seat 2 on March 9 and March 23, 2010, with the selection being made on April 13, 2010, which is the first meeting of the month. 12_ 10.1 Regular Council 2/ 23/ 10 MAYOR/ COUNCIL ANOUNCEMENTS Councilmembers expressed their condolences to the family of Mr. Miller and, stated he will be missed. Mr. Garvie discussed the session he attended by the Sheriff's Department on gang activity in Okaloosa County, and reported he attended the All- Sports Award banquet which donates proceeds to charitable organizations in the area. Mr. Rynearson noted that he contacted Staff with questions he had while reviewing his Council agenda, and advised the City Manager his questions were answered quickly and accurately by the staff. The Mayor reported that he briefed 72 second grade students from Liza Jackson Preparatory School on City issues; he observed high school students in practice interviews and that they did an impressive job; he attended a breakfast for the Fellowship of Christian Athletes and that the young people were very impressive; and reported on the Track Meet that recently took place.
