Mr. Tucker seconded motion. The City Manager commented the item went to the Municipal Planning Board as information. The City Attorney explainedher that Dr. Pullen' s concern may be that the item is coming before understanding Council for decision prior to it being presented to the Municipal Planning Board. She expressed her it is understanding that what the CDS Director is presenting tonight is not any specific decision by Council; only staff seeking direction to move forward with the plan. The City Manager further explained staff is seeking direction to move forward with the idea so that the CDS Director can formulate the ordinance amendments. She said staff is seeking direction from Council required to move forward with this item, then it goes back to the Municipal Planning Board to review the very specifics of each item, but staff did not want to work the item if Council is not interested in moving forward with it; so staff is seeking Council direction on moving forward with this item then particular elements of it will be taken back as appropriate to the Municipal Planning Board. Mr. Anderson received clarification that with the motion Council will not give staff any guidance but send it to the Municipal Planning Board, who will then present it to Council for guidance to the staff, as straight opposed to whether or not Council approves the concept of a parking plan. Dr. Pullen read a portion of the City Code that contains the powers and duties of the Municipal Planning Board and the functions of the staff, and mentioned the City Attorney will provide guidance and that the city items are within the CRA area. It was the opinion of Dr. Pullen that the Municipal Planning Board is charged as the planning facility for the city and the City staff is to support the Board. The Mayor stressed that the members of the Planning Board are volunteers and that City staff are the experts in the field. The City Manager explained that the implementation of the parking improvements would entail a great deal of time and effort from Staff, and that Council' s concurrence with the improvements is requested before Staff begins the long process of implementation. Once Staff has done their job, the elements will be returned to the appropriate city agencies. She stressed that in no way was Staff trying to circumvent the responsibilities of the Municipal Planning Board. Chris Gibson, 249 Brooks Street, clarified that this will also go before the CRA Board. The City Attorney stated it was her understating and interpretation of the Code that Staff was asking for direction from Council to go ahead with the plan as there is an extensive amount of work that Staff will have to do. She reiterated that it was brought before the Planning Board and they concurred with Staff's recommendations and to bring it forward to Council. The Mayor called for the vote on the motion and it failed by a vote of 2 to 5 with Tucker and Pullen in favor and Holmes, Patterson, Campbell, Kelley, and Anderson opposed. Mr. Kelley moved to direct Staff to begin the implementation of the Downtown Parking Improvement Strategy and advance it to the appropriate City agencies, to include the following recommendations: 1) Enforcement of parking to include establishing a two- hour time limit zone for the on- street areas delineated the eastern ~ of Block " F" and the southern side of Brooks Street from the public lot to Perry Street; provide2- hour enforcement of the time limit zone six days per week; pass an ordinance establishing the 2- hour time limit and providing for a $ 15.00 fine for each violation; and removing all 2- hour time limits in the public parking areas. 2) Parking Promotion, circulate the article on the value of an on- street parking space to all property owners and businesses in the survey area; design, print and circulate multiple copies of a parking maD of the survev area. 3- 9- 04 DOWNTOWN PARKING IMPROVEMENT (cont) 3) Pedestrian Amenities, CRA and Staff to encourage property owners to treat alleys to improve back door access to retail appearance with wall graphics, lighting and landscaping; encourage businesses; and to continue to consider the CIP to relocate Florida Place westward to provide a 90 degree intersection with Miracle Strip Parkway. 4) Signing, site parking signs have been installed at all public lots; add 2- hour time limit signs at the and end of all two- hour time limit areas; continue the Way- finding Sign system for beginning downtown. 5) Traffic operation, work with FDOT to pursue the possibility of widening the westbound approach of Miracle Strip Parkway at Perry Street to provide a left turn lane. Mr. Anderson seconded motion and it carried by a vote of 6 to 1 with Holmes, Patterson, Campbell, Tucker, Kelley, and Anderson in favor and Pullen opposed. MPB cBAIRMANj the Request of Municipal Planning Board Chairman Dick Gercak to present subjects from Municipal Planning Board Meeting. Dick Gercak, Municipal Planning Board Chairman, mentioned the Board' s decision made at their last meeting to request staff to study Mr. Edward' s report and put in appropriate verbiage. He addressed the need for clarification on the Board' s authority and communicating with staff, and mentioned the need to increase the member composition of the Board. Mr. Gercak received clarification that under the City Charter, staff receives instruction from the City Manager; the Board has the ability to request staff to look into certain items, items, or study items, but prioritization of those items falls under the authority of the begin Administration of the City and it is up to the City Manager and staff to prioritize those items. The City Manager explained when there is a conflict between staff's work plan and a new proposed work plan, staff will request guidance and direction from Council. After further discussion from Dr. Pullen regarding the powers and duties of the Municipal Planning Board, the Mayor asked the City Attorney if the vote just taken by Council regarding the downtown parking strategy was illegal in any way. The City Attorney responded it was her understanding and interpretation of the law that the City Staff did bring the issue before the Municipal Planning Board as the first step of action and brought the issue before Council to ask direction from Council, to receive Council' s concurrence to the plan. The City Attorney further stated if the Board has some disagreements going into the parking plan, the issues could be addressed as the Board reviews the ordinances and documentation prepared by Staff. The Board can then recommend any changes to Council they see fit, with the professional expertise to address the changes provided by Staff. Chris Gibson, 249 Brooks Street, reported the parking problem is not a new issue and that the CRA discussed it with Staff as long as six years ago. Doug Reed, 842 Santa Rosa Court, stated MainStreet brought the issue forward to point out some possibilities regarding parking, and stressed the need for communication among the various City boards and committees. jRECES~ The meeting recessed at 8: 55 p. m.
