AUTHORITY. The authority for enactment of this ordinance is Section 2, of 19 the City Charter, and Section 166. 021( 1), Florida Statutes. 20 21 SECTION 2. FINDINGS OF FACT. The City Council of the City of Fort Walton Beach 22 finds the following: 23 24 A. WHEREAS, an application for rezoning was received by the City of Fort Walton 25 Beach from Keith and Kimberly Brooks, the fee simple title holder of the subject property; 26 and, 27 28 B. WHEREAS a public hearing was held before the Municipal Planning Board on April 7, 29 2005, and the Municipal Planning Board has recommended the request be approved; 30 and, 31 32 C. WHEREAS, the City Council has conducted two public hearings after giving due 33 public notice pursuant to Section 166.041 (3) ( a), Rorida Statutes; and, 34 35 D. WHEREAS, the property, located at 628 Country Club Avenue NE, comprises 0. 34 36 acres more or less, and is legally described in Section 3 below; and 37 38 E. WHEREAS, the rezoning is consistent with the City' s Comprehensive Plan, 39 August 22, 2000, by Ordinance 1401, and as amended January 28, 2005, by adopted 40 Ordinance 1615. 41 42 SECTION 3. PROPERTY REZONED. The property legally described as Lot 3, Block 43 F, Country Club Estates Subdivision according to the plat thereof recorded in Plat 44 Book 3, Page 41 of the public records of Okaloosa County, Florida. 45 46 47 SECTION 4. ZONING MAP AMENDMENT. The Official Zoning Map of the City of Fort 48 Walton Beach, as described in the Land Development Code, Article III. ZONING, DIVISION 49 3. REPEAL OF ANY CONFLICTING ORDINANCES. All other ordinances or 55 provisions of other ordinances, which are in conflict with this ordinance, are hereby repealed 56 to the extent of such conflict. 57 58 SECTION 6. SEVERABILITY. If any section, phrase, sentence, or portion of this Ordinance 59 is, for any reason, held invalid or unconstitutional by any court of competent jurisdiction, such 60 portion shall be deemed a separate, distinct, and independent provision, and such holding 61 shall not affect the validity of the remaining portions thereof. 62 63 SECTION 7. EFFECTIVE DATE. BACKGROUND: The process of amending the Official Zoning Map of the City requires the adoption of an ordinance after two (2) readings before the City Council. An advertised public hearing must be held 10 days prior to adoption. As explained in the Staff Report, the applicants are seeking to rezone their property to a City zoning district ( R- 1A) after having annexed the property to the City in October 2004 and having the property designated Low Density Residential ( LOR) on the Future Land Use Map ( FLUM) in but January 2005. The property has been under County zoning and land Use since annexation is now ready to be rezoned to a City zone consistent with the LOR land use designation. There are no requirements for posting with notices, legal advertisements or public notices prior to consideration by
