3 AN ORDINANCE OF THE CITY OF FORT WALTON BEACH,
4 FLORIDA, RELATING TO THE REZONING OF CERTAIN PROPERTY
5 WITHIN THE CITY OF FORT WALTON BEACH LOCATED AT 403
6 HOLLYWOOD BOULEVARD NW; PROVIDING FOR AUTHORITY;
7 PROVIDING FOR FINDINGS OF FACT; PROVIDING FOR PROPERTY
8 TO BE REZONED FROM R- 2 MULTIFAMILY DWELLING DISTRICT
9 TO MUCC- 1 MIXED USE COMMUNITY COMMERCIAL DISTRICT;
10 PROVIDING FOR A ZONING MAP AMENDMENT; PROVIDING FOR
II CONFLICTING PROVISIONS; PROVIDING FOR SEVERABILITY;
12 AND PROVIDING FOR AN EFFECTIVE DATE.

14 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
15 WALTON BEACH, FLORIDA, AS FOLLOWS:

17 SECTION 1. AUTHORITY. The authority for enactment of this ordinance is Section 2, of
18 the City Charter, and Section 166. 021 ( 1),Florida Statutes.

20 SECTION 2. FINDINGS OF FACT. The City Council of the City of Fort Walton Beach
21 finds the following:

23 A. WHEREAS, an application for rezoning was received by the Department of
24 Community Development Services of the City of Fort Walton Beach by Victor and
25 Margherita DeMoya, the fee simple title holders of the subject property; and,
26
27 B. WHEREAS a public hearing was held before the Municipal Planning Board on
28 September 6, 2007, and the Municipal Planning Board has recommended the request be
29 approved; and,

31 C. WHEREAS, the City Council has conducted two public hearings after giving due
32 public notice pursuant to Section 166. 041, Florida Statutes; and,
33
34 D. WHEREAS, the property, located at 403 Hollywood Boulevard NW, comprises 1. 38
35 acre more or less, and is legally described as in Section 3 of this Ordinance; and,
36
37 E. WHEREAS, the rezoning is consistent with the present Comprehensive Plan,
38 adopted August 22, 2000, by Ordinance 1401.

40 SECTION 3. PROPERTY REZONED. The property legally described as Lots 1, 2, 9 and 10,
41 less the North 60 feet of Lot 10, Block 2, Oakland Addition to Fort Walton, according to the
42 Plat thereof as recorded in Plat Book 2, Page 114, of the Public Records of Okaloosa
43 County, Florida, is hereby rezoned MUCC- 1 Mixed Use Community Commercial District.

45 SECTION 4. ZONING MAP AMENDMENT. The Official Zoning Map of the City of Fort
46 Walton Beach, as adopted by Section 12.40. 06 of the Land Development Code, is hereby
47 amended to include a change of classification from R- 2 Multifamily Dwelling District to
48 MUCC- 1 Mixed Use Community Commercial District for the specific parcels described in
49 Section 3 of this Ordinance.
