BOARD OF COUNTY COMMISSIONERS
AGENDA REQUEST
DATE: March 19, 2013
TO: Honorable Chairman and Members of the Board
FROM: John Hofstad
SUBJECT: Marler Park Boat Parking Expansion & Convention Center Exhibit Pad
DEPARTMENT: Public Works
BCC DISTRICT: Two
STATEMENT OF ISSUE: As part of the design review process, the Army Corps of Engineers
(ACOE) has determined that wetland impacts from the proposed project will require mitigation.
The design, permitting, construction inspection and long term monitoring activities that are
required as part of the ACOE permit are beyond the scope of the existing task order to Atkins.
The scope and fee to perform the necessary services is provided for acceptance by the Board of
County Commissioners.
BACKGROUND: Originally approved on November 15, 2011, Atkins is working on the design
plans for the expansion of the boat parking area at Marler Park along with a new exhibit pad for
the Convention Center. Proposed improvements will have an impact on small wetland areas on
site and the ACOE is requiring mitigation for the environmental impacts.
In order to satisfy the application and permit requirements, Atkins has provided a scope and fee
to perform the necessary work (attached for reference). Included with the proposed scope is the
permit design, permit acquisition, construction oversight and long term monitoring/reporting.
All of these elements are required as part of the ACOE wetland permit. Without these elements
being approved the permit will not be issued.
The original task order to Atkins was approved by the Board of County Commissioners for a
total fee of $64,615.00. Amendments 1 through 3 have increased the task total to the current
approved value of $83,815.00. Proposed Amendment 4 requires approval by the Board of
County Commissioners because the value of the proposed amendment is greater than 10% of the
initial contract (per Purchasing Policy). The proposed amendment is for a not to exceed amount
of $14,078.00. If approved, the resulting task order total would be $97,893.00. Costs associated
with the design of this project are being split equally between the Tourist Development and
Public Works Departments.
OPTIONS: Approve/Disapprove amendment number 4 in the amount of $14,078.00 for task
order number 3 to Atkins for the Marler Park Boat Parking Expansion and Convention Center
Exhibit Pad design project.
RECOMMENDATIONS: Approve amendment number 4 in the amount of $14,078.00 for task

Marler Park Improvements Project
Mitigation Plan, Maintenance, and Monitoring Scope and Fees
March 6, 2013
Attachment: Proposed Amendment 4 (1485 : Marler Park Boat Parking Expansion & Convention Center Exhibit Pad)
Atkins is pleased to provide you with the proposal and related fee estimate for the Marler Park
property located in Okaloosa County, Florida. ATKINS will conduct additional mitigation activities as
required by The U.S. Army Corps of Engineers (USACE) and will follow USACE mitigation guidelines for
the Marler Park Improvements Project. These activities include conducting preparing a mitigation
plan, mitigation construction oversight, mitigation maintenance oversight and mitigation monitoring.
Environmental Services for the Marler Park Improvements Project will include the following
individual subtask items:
TASK 1: ATKINS will prepare a Final mitigation plan consistent with the USACE’s Mitigation Plan
Guidelines. ATKINS will design plans for a proposed mitigation area necessary to compensate for
wetland impacts associated with the Marler Park Improvements project. ATKINS will compile
baseline data (including physical data, historic and existing land uses, and resources impacted) for the
proposed mitigation area. ATKINS will compile a mitigation work plan which may include compiling a
grading plan, planting plan, and/or wetland restoration plan. This includes the preparation of GIS
exhibits and figures as needed for a proposed mitigation plan. The Atkins engineer will compose
permit drawings and renderings for the mitigation plan. ATKINS will conduct additional agency
coordination and negotiation with the USACE to address any mitigation plan comments or issues by
the permit reviewer. This coordination includes meetings, conference calls, and ongoing negotiation
related to Marler Park Improvements Project.
Task 2: Atkins will perform mitigation construction oversight. An ATKINS biologist will be onsite
during the mitigation construction to assist the contractor with any environmental questions or issues
during any earthwork and planting activities. The Atkins representative will coordinate with the
USACE if any environmental issues arise.
Task 3: ATKINS will perform oversight during any maintenance events (if necessary) in order to assist
the County in keeping the mitigation area within compliance with the USACE. ATKINS will also
perform and complete up to three (3) yearly monitoring events which includes three field visits,
qualitative and quantitative data collection, photographs, etc. The data will be compiled into yearly
monitoring reports and submitted to the USACE.
Task 4: Additional Survey (Southeastern Surveying, LLC)
Additional Services
This scope does not include state and federal listed species surveys, consultations, permitting,
monitoring, or management plans. This scope does not include an environmental assessment, which
is typically completed by the USACE based on project submittals (for NEPA compliance). This scope
does not include re‐planting coordination or additional permitting activities if the USACE finds the
mitigation area to not be in compliance after three years. These items can be added as additional
services if required.
