hearing and whether stormwater plans are material to hearing. Mr. Greg Stewart Page 5 of 5 October 29, 2015 September 29, 2015; Email from Mr. Kampert to J.Rigby re: importance of stormwater and drainage plans September 30, 2015: Email from Mr. Kampert to Randy Wise and his agents, which excludes Jill Crew, re; Randy Wise’s development application. October 8, 2015: Email from J.Rigby to Mr. Kampert confirming December 15, 2015, BCC hearing and fact that “my client's critical witnesses are available on December 15. They are all busy professionals and need as much lead time as possible. Although there are BCC meetings in November, all of our needed witnesses are not available for either of the November BCC meetings.” October 8, 2015: Emails (2): Kampert to/from Sanguyo, Jernigan, Bitterman re: traffic analysis and storm water. The County’s failure to turn over public records and information on a timely basis has prejudiced my clients’ ability to proceed with a hearing until 2016. Mr. Raimund Herden will be out of the country and our experts cannot accommodate a hearing date until 2016. VII. Randy Wise Has No Standing to Amend the Magnolia Plantation Master Land Use Plan Map. Mr. Herden, the controlling developer of Magnolia Plantation and a representative owner of BWB DRI, does not consent to Randy Wise’s amendment of the BWB Master Plan Map. Mr. Herden is the controlling developer of Magnolia Plantation, and as such, is the only one with standing to amend or alter the Magnolia Plantation Master Land Use Plan Map. In conclusion, the County cannot proceed with Randy Wise’s development application given the lack of residential entitlements, Randy Wise’s failure to include his conceptual master development plans in his development application, the restricted use of the Magnolia Plantation fairways for open space golf course, and Randy Wise’s lack of standing to amend the BWB/Magnolia Plantation Master Land Use Plan Map. These are all materials issues that have not been resolved. As stated by Mr. Kampert in one of his internal emails, “I do not believe it is appropriate to ask the BCC to schedule a public hearing if we still have issues.” Sincerely, Jill W. Crew Encl.
