BOARD OF COUNTY COMMISSIONERS
AGENDA REQUEST
DATE: February 3, 2015
TO: Honorable Chairman and Members of the Board
FROM: Jeff Littrell
SUBJECT: Mid County Tank # 4 Land Acquisition - Purchase Approval
DEPARTMENT: Water and Sewer
BCC DISTRICT: 1
STATEMENT OF ISSUE: Staff requests that the Board of County Commissioners (BCC)
approve the purchase of land for the proposed Mid County Tank # 4 and authorize the Chairman
to execute a Resolution, Purchase & Sale Agreement, and Closing Documents. This project is
partially funded by a Northwest Florida Water Management District (NWFWMD) grant. The
purchase price is $70,000 (plus closing costs) for approximately 1.1 acres of land, a utility
easement, and an access easement.
BACKGROUND: At the 5/6/2014 BCC meeting, the Board approved and authorized the
Chairman to execute the Grant Agreement between the County and the NWFWMD. This is a
$1,250,000 grant (via NWFWMD's Water Supply Development Community Assistance
Initiative) to go towards the construction of Mid County Tank #4, in which the total project cost
is estimated at $2,700,000. With the Grant Agreement approval, the BCC also authorized staff
to negotiate with property owners, obtain an appraisal, and bring back to the BCC a contract to
purchase real estate to serve as the site for the construction of the elevated tank.
Since the 5/6/2014 BCC meeting, staff has negotiated with property owners and had the land
appraisal completed per State Statutes. The Seller has agreed to a purchase price equal to the
appraisal price ($70,000). Along with this 1.1-acre purchase for the water tank site, the Seller
will be granting a utility easement and access easement (both depicted on attached map) for a
water main and ingress/egress, respectively. This land is generally described as the southwest
corner of Crestview Nursery, just east of Hwy 85, and south of Phil Tyner Rd.
Therefore, for your consideration and approval today is a Resolution regarding the purchase of
the property. With this Resolution, the BCC would be: 1) approving the attached Purchase &
Sale Agreement and authorizing the Chairman or Vice-Chairman to execute, 2) authorizing the
Chairman or Vice-Chairman, or their designee to execute and deliver any and all documentation
related to the closing documents, and 3) authorizing the Chairman and County staff to perform
the requirements of the Purchase & Sale Agreement and this Resolution. For example, should a
time extension be necessary, the Chairman or Vice-Chairman, or their designee, is authorized to
execute such an extension.
County Contract Review has been completed and the Coordination Sheet is attached for your
review. The attached Purchase & Sale agreement stipulates the closing will occur within 60
days, unless a delay is mutually agreeable to the parties. Upon BCC approval, staff will retain a
local title company to perform the closing.
Regarding the overall project, during the closing period for the land purchase, staff plans to bring
to the BCC for approval a contract with a professional engineering firm to commence on the
design of the tank and accompanying water main.
OPTIONS: Approve or deny.
RECOMMENDATIONS: Staff recommends BCC approval for the purchase of land for the
proposed Mid County Tank #4 at a purchase price of $70,000 (plus closing costs, to include the
services of a local title company to perform the closing) and authorize the Chairman to execute a
Resolution, Purchase & Sale Agreement, and Closing Documents.
