BOARD OF COUNTY COMMISSIONERS
AGENDA REQUEST
DATE: May 7, 2013
TO: Honorable Chairman and Members of the Board
FROM: Jeff Littrell
SUBJECT: Subordination of Utility Interests – FDOT Gap Creek Bridge
DEPARTMENT: Water and Sewer
BCC DISTRICT: Four
STATEMENT OF ISSUE: Staff requests the Board of County Commissioners execute a
subordination of County Utility Interests to the Florida Department of Transportation (FDOT).
The FDOT has an interest in a County Utility easement for water and sewer utilities and has
deemed it necessary for right-of-way purposes. The subordination agreement is attached for
your review.
BACKGROUND: The FDOT has plans (FDOT Project # 220162-2-52-01) to replace the bridge
located at Gap Creek on Beal Pkwy (SR 189). As part of the bridge replacement, the FDOT is
seeking additional right-of-way to construct the project. FDOT requests that the County
subordinate a 15 foot wide easement (O.R. Book 1214 Page 26) containing water and sewer lines
near the bridge. The easement is located in newly acquired FDOT right-of-way. A 4" force main
will need to be relocated due to the bridge construction. In exchange for the subordination,
FDOT has agreed to reimburse the County for the cost of the force main relocation for a not to
exceed amount of $29,304.55. The County will retain the same utility rights granted in FDOT
right-of-ways. Please see attached aerial photo depicting the locations of the proposed easement
subordination and 4" force main relocation. County Contract Review has been completed on the
subordination agreement and is attached for your review.
OPTIONS: Approve or deny.
RECOMMENDATIONS: Staff recommends BCC approval for the Chairman to execute the
Subordination of County Utility Interests agreement with the FDOT and approval of the related
Resolution.
