STATEMENT OF ISSUE: The Magnolia Forest Home Owner's Association (HOA) Magnolia
Forest @ Bluewater Bay, has finalized its approval of dedicating the road (Wren Way) to the
County for permanent maintenance. The HOA is requesting the Board of County Commissioners
accept the attached Special Warranty Deed.
BACKGROUND: The Board of County Commissioners accepted Wren Way into the County's
permanent maintenance system at their January 17, 2012 meeting by majority vote. It was noted
that this roadway presented a unique set of circumstances that would lend itself to approval even
though the right-of-way is less than that which is required under the Land Development Code.
The Magnolia Forest HOA, through their legal representative, has prepared a Special Warranty
Deed granting the Board ownership of the real property identified as "Wren Way," a singular
roadway with boundaries and dimensions as depicted on the recorded plat of Magnolia Forest at
Bluewater Bay Subdivision, said plat being recorded on May 21, 1996, in Plat Book 16, Page 43
of the public records of Okaloosa County, Florida. Subject to the condition that the real property
conveyed shall be used as a public roadway which is maintained and repaired for the public use
by Grantee (Okaloosa County a political subdivision of the State of Florida).
OPTIONS: Approve/Disapprove acceptance of the Special Warranty Deed for Wren Way and
recording of the same.
RECOMMENDATIONS: Approve the acceptance of the Special Warranty Deed for Wren
Way and recording of the same.
