Joyce & David
I am forwarding this contract to Suzanne Brown less for review.
Considering the legislation passed about our
franchise and the CST issue, I believe it is in the City' s best interests to have her review the contract.
I spoke to Suzanne about it. She may not be able to respond this week in time for the Jun 26
agenda. Perhaps,
Suzanne should give us a timeline of her review before we schedule it on the Thank agenda. you.

Helen & Joyce
apologize for the confusion. I just spoke with Jeff Mcinnis regarding this matter. Section 2. 00. 051 Disposition Procedures,
authorizes disposal of excess property by negotiated sale. I recommend that the City
Manager request authorization ffom City Council
to enter into preliminary negotiations for the sale of the
property with Waste Management. The Contract will be in two phases. Phase I
will permit WM to enter the property to conduct testing for feasibility of use. The results of the
feasibility study will be available for
both parties. After the testing, the price will be negotiated and a contract for sale presented to Council for
approval.
With this method, adveliising and notice will not be needed until after the
feasibility period. However, we will have the testing
information available for the appraisals and the right to cure any damage to the property during the inspection.
I suggest that the fIrst authorization be a consent agenda item on next meeting. Thank you.

I guess I misunderstood from Toni, and that we will have to go all the way through with WM being the high bidder and

egin negotiations with the CM before they can go on the property to obtain a Phase I Environmental Study.
Is that correct?

This does not meet with my approval. What I said was that the CONTRACT for sale will include a feasibility period. It is
not the application that should allow the inspection. Only the valid contract negotiation should allow any entry on the land.
