UNITED STATES DISTRICT COURT NORTHERN DISTRICT OF FLORIDA PENSACOLA DIVISION CHRISTINA MARTIN, Plaintiff, vs. CASE NO. 3:13-cv-00375-MCR-CJK OKALOOSA COUNTY BOARD OF COUNTY COMMISSIONERS, Defendant. __________________________________/ SETTLEMENT TERM SHEET Christina Martin (“Martin”), by and through her below signed attorney, and Okaloosa County Board of County Commissioners (the “County”), by and through its below signed attorney, do confirm that the following settlement was arrived at a Settlement Conference before the Honorable Charles J. Kahn, Jr., United States Magistrate Judge: 1. The County shall pay to Martin the total sum of $75,000.00 in full satisfaction of any and all claims that it has against the County, including any and all claims for attorney’s fees and/or costs. 2. That upon payment of the above amount, Martin will provide a release of the County, its employees, officers and agents in a form acceptable to the attorney for the County. 3. Upon payment of the above amount, Martin will dismiss the above styled action with prejudice. 4. Martin will agree that she will not apply for any position with Okaloosa County for a period of five (5) years from the finalization of this Settlement.  5. This settlement shall be conditioned upon the approval of the Board of County Commissioners. This Agreement is entered into for the purposes of settling a contested claim. No provision of this Agreement or the act of entering into the Agreement itself shall admissible in any proceeding except as to the enforcement of this Settlement or be construed as an admission by the County as to the validity of the claim by Martin, or as to the validity of any defense or avoidance asserted by the County.
