( City Attorney) ( See Backup) MOTION: DIRECT THE CITY MANAGER AND CITY ATTORNEY TO SCHEDULE A TIME FOR AN EXECUTIVE SESSION TO DISCUSS CITY VS. SHARPE AND CITY VS. SAND PINE REALTY, AND ANY OTHER ITEMS THE CITY MANAGER MAY HAVE. 7 -0. CA —Pursuant to Chapter 286 of the Florida Statutes the only meetings that the City Council can hold outside of the public are those in which you have an executive session and, of course, there are a couple of other times you can do so whenever you' re dealing with your union stuff. However, these two cases have been pending for some time for the City for one reason or the other and I just simply request that we have an executive session so I can get Council advice on moving forward toward settling the cases. And that time would be when Ms. Spencer could determine, unless there is already a scheduled thought. MS —and your desire is to do both cases at the one session? CA —yes CM —do we know about how long that will take? CA —I' d say probably about 30 minutes. CM —the reason I ask is because we also need to schedule an executive session to bring back to you some issues with our labor negotiations with the fire union. And I' ve got some dates of when Mr. Mattimore is available, and I' m conscious about Council' s availability. The dates that he' s available, if you want to do them both at the same time, if I may Helen, are the 15th and the 29th that are Tuesdays. The 15th is the League of Cities dinner that night so unless you wanted to meet at 4: 00, which you probably don' t, if you did then we could meet at 4:00 and then give you plenty of time but 1 see heads shaking so I won' t suggest that. But the other would be the 29th of January, and that is not a regular Council meeting night, but it is a Tuesday. CA —but I won' t be available. CM —well then how about if, may I suggest one other? MA —I suggest you guys work it out because all you want to do is set up a time CA —correct MA —you and Ms. Craig get together and then find out if we' re available. I think that' s the plan isn't it. OK, so do you need a motion? CA —yes to schedule it. MM — move to direct the City Manager and the City Attorney to schedule a time for an executive discussion to discuss those things in item 18 and what the City Manager has. DR —second MA —okay Mr. Reeve' s seconded Mr. Minich' s motion. Any further discussion on this? Seeing none please vote. It does pass unanimously, thank you. Looking forward to an executive session. I sent Joyce a verbatim of the portion in the last minutes and requested she advise me when to call this Executive Session. At that time the Fire Union was also included but I understand this needed to be accomplished first so this was set up for just the Fire Union. As soon as Joyce lets me know I will call Council and arrange the Executive Session for Sharpe and Sand Pine Realty and will keep you informed.
