independent testing laboratory acceptable to the OWNER and the ENGINEER to perform all inspections, tests, or approvals required by the Contract Documents except: 1. that costs incurred in connection with tests or inspections conducted pursuant to paragraph 13.04.B of the General Conditions shall be paid as provided in said paragraph 13.04.B; and 2. as otherwise specifically provided in the Contract Documents. Supplement subparagraph 14.02.B.5 of the General Conditions as follows: In addition to reasons listed in G.C. 14.02.B.5.a through 14.02.B.5.d, the ENGINEER may refuse to recommend the whole or any part of any payment to the CONTRACTOR because liability for liquidated damages has been incurred by the CONTRACTOR. INSPECTION OF FACILITIES The CONTRACTOR shall at all times provide access to, and all means necessary to provide for inspection of all parts of the work by the OWNER. 2. UTILITIES The CONTRACTOR shall be responsible for any damage done by him or any of his subcontractors to all utilities within the limits of the work. Should any utilities or appurtenances be damaged by the CONTRACTOR's activities and operations under this contract, the CONTRACTOR shall cause the necessary repairs to be made and shall pay the entire cost thereof without compensation. No separate compensation shall be allowed the CONTRACTOR for any work required by this paragraph due to conflicts with lines and appurtenances or as a result of grade revisions. 3. REMOVAL OF DEBRIS The CONTRACTOR shall frequently clean up all refuse, rubbish, scrap materials and debris caused by his operations, so that at all times the site of the work shall present a neat, orderly @ and workmanlike appearance. 4. TEMPORARY ROADS, DETOURS AND MAINTENANCE OF ACCESS A. No section of the work shall be closed to traffic unless approved by the OWNER. Suitable signs indicating "Road Closed" or "Detour" shall be erected by the CONTRACTOR as ordered by the OWNER at no expense to the OWNER. B. If in the opinion of the OWNER the CONTRACTOR does not comply with the above requirements such work as the OWNER may deem necessary may be performed by others at the direction of the OWNER and the charges therefore held from any money due or to become due to the CONTRACTOR on this or any other Contract. 5. BARRICADES, WARNING LIGHTS, SIGNS, ETC. A. Prior to closing any section of the project to traffic, the CONTRACTOR shall furnish, erect, and maintain, at no expense to the OWNER suitable barricades, warning signs, flares, red flags, or lights which shall be kept burning from sunset to sunrise. The CONTRACTOR shall receive no direct compensation for furnishing, erecting, and maintaining the necessary barricades, lights, flares, signs, or for any other incidentals necessary for the good and proper safety, convenience, and direction of traffic during the period prior to final inspection and acceptance. 6. CONSTRUCTION ALONG AND UNDER HIGHWAYS When Work is to be performed under Federal, State or County Highways, or along the right- of-way of these highways, the CONTRACTOR is instructed to contact the State Highway Department, the OWNER or other authorities concerned as to their requirements for Work of this type and for maintaining traffic, detours and public safety during these operations. These requirements shall be fully complied with and all work along or tnder these highways shall be subject to the inspection and direction of the proper authorities concerned. The CONTRACTOR shall give prior notice of his intention to perform work along these highways and shall coordinate the work with the highway authorities concerned. The CONTRACTOR shall provide at his own expense any bond or insurance required by the Highway Department. 7. EXTRA CHARGES r Upon receiving a change order or field order, the Contractor shall notify the Engineer of any additional charges the Contractor feels he is due prior to initiating the work under consideration. 8. CONTRACTOR'S CLOSEOUT SUBMITTALS TO ENGINEER A. Upon final completion and acceptance of the Work in each Change Order, the CONTRACTOR shall submit a final settlement of accounting to OWNER. B. Statement shall reflect all adjustments to the Contract Price: 1. The Original Contract Price 2. Additions and deductions resulting from: a. Previous Change Orders b. Unit Prices C. Deductions for uncorrected work d. Penalties and Bonuses €. Deductions for liquidated damages f. Deductions for re-inspection payments g. OWNER will prepare a final change order, reflecting approval adjustments to the Contract Price which were not previously made by Change Orders. D. The CONTRACTOR shall submit the following closeout documentation along with the final settlement of accounting: 1. Release of Liens ~ The CONTRACTOR shall submit a certified letter from the CONTRACTOR to release and discharge the OWNER, its officers, agents and employees of and from all liabilities, obligations, and claims under or arising out of said contract. CONTRACTOR's Advertisement of Completion - The CONTRACTOR immediately after being notified by the OWNER that all other requirements of their contract as pertains to the Work Order have been completed shall give notice of said completion by an advertisement for a period of 4 successive weeks in the newspaper of largest circulation published within the county or counties where the work is performed. Proof of publication of said notice shall be made by the CONTRACTOR to the OWNER, by affidavit of the publisher and a printed copy of the published notice. If no newspaper is published in any county where the work is done, the notice may be given by posting at the Court House for 30 days and proof of same shall be made by the Probate Judge or Sheriff and the CONTRACTOR. Use the form for Advertisement of Completion in Section.
